Building Permits Continued:

COMMUNICATIONS.
Petition for Light:
3 A communication from the Port Townsend Chamber of Commerce was presented
and read, as follows:

Gentlemen:
At a regular meeting held November 23rd, the Port Townsend Chamber of Com-
merce went on record as requesting your body to place two of the street lights of the new
lighting system at or near the vicinity of the Washington Fishermen's Co -Operative Packing
Co. and the Boat Harbor.

Said communication was referred to the Committee on Fire and Light.
Damage to Main Line:
A communication from City Engineer Sadler presenting a letter fro at the
National Paper Products Company, relative to a break in the pipe line from the Quilcene
River, was presented and read, as follows:
To the Mayor and City Council December 6, 1932
Port Townsend, Washington.
Gentlemen:
Attached to this communication is a letter from Mr. E. W. Erickson, Res.
Mgr. National Paper Products Co. in regard to washout on main lines of the Big Quilcene,
water supply line at Station 627 00.
I have just returned from a trip up there and find that,the break was
caused by a windfall some 401 from the right of way, coming down the hillside and struck
the 30" Pipe causing a break sometime during Wednesday evening and Thursday morning.
This water :from the break washed a hole under the Pipe about 35 ft. wide
and 30 ft. deep, the Pipe has been supported on stringers and the Paper 6ompanies crew
is at work building a crib and filling in the hole, this hole will take from a 1000 to
1200 Cu. Yds. to fill.
The ground on the hillside above the break is saturated from the recent
heavy rains, and the crew will do well if they can get the cribbing built and the fill
made before this ground slides, the place where the washout occured is in an old burn and
the same thing can happen along the line for several miles, unfortunately it would be quitei
expensive to clear out all of these dead snags as they are all off the City Right of way,
but at the same time when they come down they will undoubtedly come toward the Pipe and
possibly cause the same trouble that this one has.
Theburn is some 8 years old now and the wind is bringing them down quite)
frequently, the cost of this work will probably have to be borne by the City as in my
opinion it is not ordinary maintenance but an act of God, however the City Attorney should
give you an opinion on this. The cost I think will run close to•4600.00. i believe the
Paper Company is doing this work to keep the cost under this figure is possible.

Attention Mr. W. J. Sadler, City Engineer
Dear Mr. Sadler:
This will confirm our telephone conversation this morning relative to
break in pipe line and washout underneath it at Station 627 - 00.
As we told you, the line has been repaired and suspended in the air for
about thirty-five feet over a gully approximately thirty feet deep, which has been washed
out and which we feel it is necessary to crib up and fill in in order that the pipe can
be put back in a safe condition.
We have obtained an estimate for this work from outside contractors and
find that this is approximately $600.00. We feel that it is possible for us to do this
work with our mill forces here at a figure somewhat lower than this and accordingly are
proceeding with the work ourselves.,
We are calling this .to your attention since we are not certain whether
this washout can be classed as maintenance on the line, and as such be borne by us, or
as an act of God and be borne by the City. We will endeavor to obtain information regard
ing this and in the meantime we believe it would be advisable for you to investigate the
work in case it should be found that this expense should be borne by the City of Port
Townsend.

In relation to the liability for the cost of repairs to the pipe line,
City Attorney Scott stated upon inquiry that it was solely a question of fact. The said
communications were then referred to the Water Committee, the CSty.Engineer and the City
Attorney.
RE: Forty Mill Levy:
City Clerk Christian reported that in reply to an inquiry he had address
to the State Auditor, relative to the forty mill tax limit levy, Mr. Fred D. Chesnut
quoted from an opinion of the Attorney General's office thab the said forty mill limit
law did not affect the 1932 levies.
REQUISITIONS.
Street Department:
Street Superintent, J. R. Pollard, presented a requisition for the foll(
ing supplies, to -wit:

It was moved by Councilman Lafferty and seconded by Councilman Miller
that the said requisition be granted. Motion declared carried.
ORDINANCES AND RESOLUTIONS.
Depository Bank:
A resolution as prepared by City Attorney Scott designating the deposi-
tory bank'for depositing of city money for the year 1933 was submitted and read, as follow
RESOLUTION
Resolved by the City Council of the City of Port Townsend, Washington,
that the First American National Bank of the City of Port Townsend, Washington, be and the
same is hereby designated as the depository bank for the deposit of City Money for the
year 1933; and that a copy of this resolution be delivered to the City Treasurer of said
City.
Adopted by the City Council, December 6th, 1932.
It was moved by Councilman Smith and seconded by Councilman Lafferty that
the said Resolution be adopted. Upon roll call all four Councilmen present voted in the
affirmative and motion was declared carried.
Interest Coupon Resolution:
A resolution prepared by the City Attorney, relative to issuing interest
coupons, was presented and read, as follows;
R E S O L U T I O N
Resolved by the City Council of the City of Port Townsend, State of Washington, and 1
is hereby Ordered, that Forty-nine (49) interest bearing coupons, numbered forty-three
(43), be issued in the sum of twenty-seven dollars and fifty cents 1$27.50) each, payable
January first, 1933, as the semi-annual interest due on Forty-nine housand Dollars
($49,000) bonds of said City due and payable July first, 1931, and now an outstanding,
unpaid and "a general and binding obligation of said City; and that the Mayor and City Cler
of said City are hereby directed and ordered to sign and execute said coupons, in the
form as prescribed and set forth inoord.inance No. 1015 of said City; and be it further
Resolved that the Fiscal Agency of the State of Washington, at the City of New York,
State of New York, isthereby authorized to pay such interest coupons and cancel same as
provided by said ordinance No. 1015; that the City Treasurer of said City shall proceed
in the same manner as provided by said ordinance No. 1015; and that a certified copy of th e
resolution be forthwith forewarded to said Fiscal Agency, together with said coupons.
Adopted by the City Council, December 6th, 1932.
