COUNTY OF JEFFF.RSON ) SS. CITY OF PORT TO" 1ISEND) C. F. CHRISTIAN, being first duly sworn on oath, deposes and says that he is the regularly elected, qualified and acting City Clerk of the City of Port Townsend, State of Washington; that he posted notices, the annexed of which is a full, true and correct copy, In the following places in the said City of Port Townsend, Washington, as follows: One at the front door of the City Hall in the City of Port Townsend; One at the front door of the Jefferson County Court house; One on the bulletin board at the corner of Taylor and Water Streets in said city; and One on each of the parts of streets sought to be vacated. That such posting was made on the 9th day of February, 1932. C. F. Christian Subscribed and sworn to before me this 1st day of I -larch, 1932. Jas. W. B. Scott. The following is a full, true and correct copy of the "Notice of Time;and Place of Hearing" referred to in the foregoing affidavit, to -wit: NOTICE OF T11ME AND PLACE OF }TEARING OF PETITION TO VACATE PARTS (F STREETS. ------------------------------ JEFFERSON CW NTY, a municipal sub -division of the State of Washington, by and through its Bm rd of County Commissioners, having filed with the City Council of the City Of Port Townsend, a petition seeking the vacation of the Arts of streets in said city here inafter particularly described and the said City Council having heretofore, by resolution, filed the time and place for the hearing of the same, now therefore, 140TICE IS HEREBY GIVEN that said petition shall be heard on Tuesday the lst day of March, 1932, at the hour of 7:30 o'clock P.M. on said ;lay, or as soon thereafter as the matter can be heard, before the City Council of the City of Port Tafnsend in the council chambers of the said city council in the City Hall, Port Townsend, Washington, when and where any person or persons may appear and make objectim s or exceptions thereto. The parts of streets sought to be vacated are described as follows, to -wit: The parts of Franklin, Jefferson, Washington and Water Streets between the east line of Jackson Street and the inner harbor line; Parts of Hudson Street between Block 50 of the Original Townsite and Block 1 of Tide'= c.r! land District No. 11; also between Block 47 of the Original Townsite and Block 1 of Tideland District No. 12; and also, between Blocks 1 and 2 of the Original Townsite; Clallam Street between the south line of Lawrence Street and the north line of Front Street. Clay Street between the south line of Clallam Street and the inner harbor line. East Front Street between the south line of Lawrence Street and the inner harbor line WITNESS my hand and the official seal of the City of Port Townsend, Washington, this 4th day of February, 1932 (SEAL) C. F. Christian, City Clerk. Mayor Bangerter then called for objections or exceptions to the said petition for va- cation if any there be and none were offered. Councilman Starret stated that one adjoin- ing pr,@perty owner was more or less opposed to the vacation but he was sure the matter could amicably adjusted. Petition Granted. It was then moved by Councilman Lammers and seconded by Councilman Starrett a e sad petition for vacation be granted. Upon roll call, Councilmen Lafferty, Lammers, Miller, Starrett and Peach voted in the affirmative and Councilman Smit in the Negative. Motion declared carried. ORDINANCE OF VACATION: Reverting to order of business, "Ordinances and Resolutions" An Or nance was presented entitled "An Ordinance of the City of lWt Ta'insend vacating per s of certain streets in said city, and repealing Ordinance No. 980, passaiby the City Counci August 20th, 1929, noproved by the Mayor August 20th, 1929, entitled "An Ordinance of the City of Port Townsend vacating parts of certain streets in the Original Townsite of said City" and was read in full for the first reading. It was moved by Councilman Lammers and Seconded by Councilman Peach that the first reading be considered the second reading and that the third reading be by title only. Upon roll call Councilmen Lafferty, Lammers, taller, Starrett and Peach voted in the affirmativ and Councilman Smith in the negative. Motion declared carried. Third Reading. 'he City Clerk then read the said ordinance y title only for the 3rd reading. b` To pass this session. It :was moved by Councilman Starrett and seconded by Councilma Lammers that the said orn nance be taken up for final passage at this session. Upon roll call, Councilmen Lafferty, Larnmers, ,,Iiller, Starrett and Peach voted in favor thereof and Councilman Smith in the negative. Yotfon declared carried. ORDINANCE PASSED. It was then moved by Councilman Lammers and seconded by Councilman 6tarrett that said ordinance do now puss. Upon roll call, Councilmen Lafferty, Lammers, Miller, Starrett and Peach voted in the affirmative and Councilman Smith in the negative. (Vacation Ordinance) The following is a full, true and correct copy of said Ordinance No. 1016, as passed by the City Council March 1st, 1932, approved by the Mayor March 2nd, 1932, and published in the Port Townsend Leader March 3rd, 1932, to -wit: : ORDINANCE NO. 1016. : AN ORDINANCE of the City of Port Townsend vacating pirts of certain streets in said (' city, and repealing Ordinance No. 980, passed by the City Council August 20th, 1929, appro- ved by the Mayor August 20th, 1929, entitled "An Ordinance of the City of Port Townsend i vacating parts of certain streets in the Original Townsite of said city." The City of Port Townsend, Washington, do ordain as follows: Section 1. That the following named In its of streets be and the same are hereby va- cated, to -wit: The parts of Franklin, Jefferson, Jefferson and Water Streets between the east line o Jackson Street and the inner harbor line; Parts of Iiudson Street between Block 50 of the Original Townsite and Block 1 of Tide- land District No. 11; also, between Block 47 of the Original Townsite and Block 1 of Tide- land District No. 12; and also, between Blocks 1 and 2 of the Original Townsite; Clallam Street between the south line of Lawrence Street and the north line of Front Street; Clay Street between the west line of Clallam Street and the inner harbor line; East Front Street between the south line of Lawrence Street and the inner harbor line.
