TO THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, Comes now NATIONAL PAPER PRODUCTS COMPANY, a corporation, And' -makes, files and presents this claim against THE CITY OF PORT TOWNSEND, as follows, L n 11 0 0 201 (Claim continued) I. That plaintiff is a corporation organized and existing under and by virtue of the laws of the State of California and licensed to do business in the State.. of Washington, and that its license -fee last due said State of Washington has been paid. II. That on the 3rd day of March, 1928 The City of Port Townsend, a municipal corporation of the State of Washington, did enter into a lease with claimant, National Paper Products Company, a corporation, wherein the said City did lease to the said Company a certain pipeline and waterworks system lying outside of the limits of the said City of Port Townsend. • III. That in pursunnoe of said lease the said City did proceed to acquire certain easements and rights of way in order to lay said pipeline and in order to carry out the terms of its lease with the claimant company. IV. That on the-24th day of April, 1928, the said City of Port Townsend did enter into an agreement with the Chns.R.MoCormick Lumber Co., a corporation, wherein said Chas. R. McCormick Lumber Co. granted to the said City of Port Townsend a perpetual easement to lay and maintain said pipeline for the transports- tion of water over and eoross certain land of the said Chem. R. McCormick Lumber Co., more particularly described in said agreement. V. That paragraph 3 0£ said agreement between the City of Port Townsend and the Chas. R. MoCormick Lumber Co. is hereinafter set forth as follows, "The grantee agrees that the pipe line shall be buried during the entire length of the easement herein granted to such a depth as will protect the pipe line against all damage because of the logging operations, of the grantor, or resulting from any other cause, and as will insure that there shall be no interference or obstruction to the loggingoperations of the grantor in, upon, or adjacent to the thirty ft. strip." VI. That the said City of Port Townsend, contrary to the terms of said agreement, failed to lay said pipeline at a depth sufficient to protect it from the logging operations of the said Chao. R. McCormick Lum- ber Co. end the said Lumber Company did thereupon make demand upon the said City of Port Townsend and this claimant to perform such work as was necessary to protect said pipeline from said logging operations. VII. That the said City of Port Townsend was at that time unable to advance the sum necessary to protect said pipeline, as aforesaid, and did request this claimant, lessee of said pipeline, to advance said money for the purposes aforesaid. VIII. That pursuant to said request this claimant did advance the sum of $10,375.00 and said sum was used to protect said pipeline from said logging operations. IX. That The City of Part Townsend is indebted to amid National Paper Products Company, a corporation, for said sum of $10,375.00 so paid to the Chao. R. McCormick Lumber Co. at the request of said City; that said National Paper Products Company has heretofore make demand upon said City of Port Townsend for the pay- mont of said sum but same has not been paid nor has any part thereof been paid by said City of Port Townsend to said National Paper Products Company. WHEREFORE, this claimant, National Paper Produots Company, a corporation, demands payment from The City of Port Townsend of the sum of $10,375.00. NATIONAL PAPER PRODUCTS COMPANY BY A. B. Lowenstein, resident manager of the National Paper Products Company, to asoer- tain if some regular meeting date of the City Council in January would be satisfactory to the paper company for a hearing of the above claim.
