Gentlemen:
We are again calling your attention to our controversy with the Charles R. McCormick Lumber Compass
which arose in connection with the way the Port Townsend pipe line was laid through the McCormick right-of-
way, which construction was not in accordance with the terms of the City's easement and resulted in our be-
ing forced to pay the McCormick Lumber Company $10,375.00 duo to the City's non-porformance of the terms of
the easement and to prevent serious damage to the City's pipe line and consequential interruptions of water
service.
On March 15, 1930 we called this matter to your attention and requested that the City of Port Town
send give us acme form of evidence whereby the City recognized their responsibility in this matter and also
work out some plan whereby we would be reimbursed for this $10,395.00 some time during the life of our water
lease.
Over a year has now elapsed and no action has been taken by the City Council and no word has been
received from you outside of a statement that you had the matter under consideration.
Will you kindly bring this matter to a head and take definite action one way or the other so that
tihs matter does not continue to drag out indefinitely.

Gentlement Res Unoae School.
In August 1929 we were requested to temporarily permit the Unoae School to obtain their water supply
from the Port Tayneend pipe line. Wo were glad to cooperate with you and accede to this request with the
understanding, however, that this tap -off would be disconnected when their wall, which we understood was be-
ing constructed, was completed.
This understanding wan confirmed to Mr. Quenell, who was then Chairman of the Water Committee, in our
letter of August 31, 1929, copy of which we are enclosing.
It has come to our attention that not only was this tap -off not disconnected in accordance with our
agreement, but that the Water Department has ever since been collecting a monthly revenue for this water
service.
Obvioubly the above is in direct violation of the terms of our lease and, as previously called to your
attention, we reserve the right to require full performance of the terms of the lease to be performed by the
City of Port Townsend.

Gentlemen:
Your attention is celled to our letter of August 31, 1929, copy of which we are enclosing, in
particular the fourth paragraph.
The taproffs not provided for in the torms'af our lease in existence at the time we took over the line
consisted of the followings
F. J. Bailey, Aroadia Inn, Chevy Chase Golf Club, Mies Mamie Chase.
In accordance with this fourth paragraph, we confirmed this understanding with each of the above par-
ties, of which the enclosed copy of our letter to Mr. Bailey serves as an example.
Lately there has been a tendency to make additional connections to Mies Chiles's line, which connections
have been made without her permission or without our pormission, and are in direct violation of the terms of
our lease.
We specifically refer to the connection of a Mr. Joyce who operates a service station at the end of the
concrete highway at Keymes out -off and the connection of the Puget Sound Power & Light Company in the vicini.

In the letter case we are very much surprised to learn that the City Water Department has actually been

It was moved by Councilman Peach and seconded by Councilman Lammers that the requisition be
granted. Motion declared carried.
ORDINANCES AND RESOLUTIONS.
Resolution to Re-imburse Current Expense Funds
To reimburse the Current Expense Fund for advance payments made in the early stages of the im-
provements to the Olympic Gravity Water Works, the following Resolution was presented and read, to -wits

Resolved, by the City Council of the City of Port Townsend, Washington, that the City Treasurer be, and
she in hereby directed to transfer from the "Water Bond Improvement Fund," Ordinance No. 997, the following
sums of money paid out of the "Current Expense Fund" of the city by order of the City Council, for certain
expenses incurred, such as engineering, labor, printing, publishing and other necessary miscellaneous inoi-
dental expenses in carrying out the project undr said Ordinance No. 997, before the bonds were sold and the
money received therefor, to-witt the sum of $169.35 to the Current Expanse Fund, and that a copy of this res-
olution be furnished and delivered to the said City Treasurer.
Resolution ado teds It was moved by Councilman Peach and seconded by Councilman Lammers that the said
resolution be adopts Upon roll call, all six councilmen present voted in the affirmative and motion was
declared carried.
The resolution was then approved by the Mayor, this date, and attested by the City Clerk.

RENEWAL, FORT RORDEN WATER CONTRACT.
Mayor Authorized .to sign renewal.
The City Clerk stated to the Council that he had received a telephone request from the Quartormaster's
Department at Fort Warden, that the City Council, by appropriate action, authorize the proper officer to eigt
the renewal form of the Government of the contract for supplying Fort Warden with water in accordance with
the optional clause in the original contract.
Motions It was then moved by Councilman Lammers and seconded by Councilman Peach that the Mayor be au-
thorized to sign the said renewal of the contract for one year, for supplying Fort Warden with water, all at
the present rates. Motion declared carried.
MARTIN ADDRESSES COUNCIL.
By permission, Mr. P. H. Martin nosy addressed the Council in relation to building a wharf on Monroe St..
extended, and after some discussion, it was decided that no notion could be taken by the Council until a re-
quest for a franchise to build the said wharf was presented to the Council.
