S. Forest Reserve for a right of way j for the Big Quilcene water supply line across public lands. I Will you please ask the Mayor to sign these maps, sign them yourself, and seal them, returning them to us. We have prepared the necessary data to accompany these applications consisting of stream flow re- cords, field notes, certified copies of water rights, report, etc. and upon receipt of these maps will make the filing with the land office. As you may know, the City has merely a temporary permit from the Forest Service and it is the proper procedure to apply for a permanent right of way after a project is completed. V. Savidge, Commissioner of Public Lands, were presented and read, as follows: Port Townsend, Wash. , October 28, 1930 iTo The Honorable Mayor and City Council, Port Townsend, Washington. Gentlemen: We have made application to the Department of Public Lands of the State of Washington for harbor f area fronting the property owned by us consisting of Lots 6 and 7, Block 5 of the Original Townsite of Port L Townsend and Tide Land District 25. Also for the harbor area fronting Madison bereau, which adjoins our property and which has been leased tp us by the City of Port Townsend. We wish to secure this harbor area due to the fact that we have been making improvements on the pro party, having recently constructed a small dock at that location and we wish to extend this dock about one hundred feet further out. However, we do not care to make further expenditures without the assurance of the harbor area. a Enclosed is a copy of letter from Mr. C. V. Savidge, Commissioner of Public Lands, in which he states that it is not the policy of the departmentcto lease areas in front of street ends unless same is not needed for public purposes. Regarding the harbor area in front of Madison Street, you are advisied that it is not the policy of this department to lease areas in front of street ends unless same is not needed for public purposes, and iit is suggested that you take this matter up with the city and port authorities, with a view of securing a statement that the area in front of Madison Street is not needed at this time. Chesnut Re 'Transfer of Funds: Communication from Fred D. Chesnut, Chief Examiner, State Auditor's Office, in reply to an inquiry from the City Clerk, was presented and read, as follows: . Olympia, Oct. 25, 1930 Mr. C. F. Christian, City Clerk, Fort Townsend, Washington Dear Sir: - We are in receipt of your letter of Oct. 24, submitting the following question: "Will it be contrary to the provisions of the Budget Law to'transfer (by resolution) funds pro- vided for salary of an Assistant Superintendent of the Water Department in the amount of 8420.00 to the item of Labor for operation and maintenance of the eity's water system?" Section 2 of Chapter 156, Laws of 1923 sets forth that Estimates, Appropriations and Expenditures shall be classified under General Classes. Section 5 of said chapter states that transfers between General Classes provided in said Chapter 2 shall not be permitted. In direct answer to your question, you are advised that the only way we can see that you can avail yourselves of the funds provided for salary of the Assittant Superintendent is to use the Emergency nlause as set forth in Section 6 of the Budget Act. D REQUISITIONS Requisition for supplies was presented and read, as follows: For the Street Department, to -wit: - New rubber tires on rear wheels of grader. J. R. Pollard It was moved by Councilman Robbins and seconded by Councilman Lafferty that said requisition be granted. Upon roll call all five.Councilmen present voted in the affirmative and motion was declared carried. ORDINANCES AND RESOLUTIONS Emergency Ordiance for Street Department: A proposed Emergency Ordinance, appropriating additional funds for the Street Department of the City, and entitled: "An Ordinance declaring an emergency appropriation and expenditure of the sum of $ , for the payment of extra labor for the Street Department of the City, and authority to issue emergency warrants in payment therefor." was introduced and read in full. Councilman Lafferty moved that $100.00 be inserted in the Ordinance as the amount appropriated, but said motion received no second. Mr. Pollard, Street Superintendent, "a then requested to state to the Council as to the extra help re- quired and stated in reply that there was considerable work to be done along the sea wall on Water Street; that a number of culverts should be installed and that the extra work would require an extra man for the balance of the year. It was then moved by Councilman Robbins and seconded by Councilman Lammers that the amount of $250.00 be inserted in the proposed emergency ordinance for the Street Department. Upon roll call all five Councilmen present voted in the affirmative and motion was declared carried. Date of Hearing Ordinance: It was moved by Councilman Robbins and seconded by Councilman Lafferty that the hearing on the said proposed Emergency Ordinance be set for November 18th, and the Clerk be instructed to give proper no- tice of same. Motion deblared carried. Emergency Ordinance for Street Department: City Clerk Christian advised the uouncil that funds for labor in the Plater Department had also been exhausted with October claims and it was moved by Councilman Robbins, and seconded by Councilman Laf- ferty, that the City Attorney be instructed to draw an emergency ordinance for labor for the Water Depart- ment for the amount necessary. Motion declared carried.
