Christian, City Attorney James W. B. Scott and Councilmen Harry W. Robbins, W. B. Smith, 71. S. Lafferty and William Lammers. MINUTES APPROVED It was moved by Councilman Robbins and seconded by Councilman Smith to approve the minutes of October 7th as written. Motion declared carried. rr c°�w r, ) aw f ttt ,y r� ' - The premises being within the fire zone the following application was presented separately: Port Townsend, Wash., Oct. 20, 1930 To the Honorable Mayor and City Council, Port Townsend, Wash. Gentlemen: Permission is requested to enlarge the building at present occupied by Frye & Co., on the South side of Water. St., Between Adams and Taylor Streets, by building a now 6" concrete wall about 4 foot easter- ly from the present frame wall, and to be approximately 85 foot long, making an addition of about 4 ft x 85 feet to the present building on the easterly side. Also to remodel the front by putting in a modern storefront. Cost is estimated at $700.00. Blue print of project is herewith submitted. Respectfully submitted, EMILIE A. ROTHSCHILD It was moved by Councilman Lammers and seconded by Councilman Lafferty that the permit be not granted. Upon roll call Councilman Lafferty and Lammers voted in favor of the motion and Councilmen Robbins and Smith voted in the negative. Being a tie vote, motion was.doolared lost. COMMUNICATIONS From Jones and Crouton: A communication from Jones and Crouton by 71. J. Daly, Jr., their attorney, was presented and read, as follows: ' October 21st, 1930. Honorable Mayor end City Council, City of Port,Townsend, Washington. Gentlemen: We have on hand unused from the Water Street improvement job some 300 foot of 12-inch Class 200 DeLavaud C.T. Pipe. This pipe cost us delivered at Port Townsend $1.58 per foot. This pipe was ordered in accordance with plans and specifications of the City Engineer, but in view of the fact that the proposed route of the pipe line was shortened by proceeding along the shoulder of the State Road No. 9 from Water Street to Kearney street, the above quantity of pipe was not used. In the light of contemplated water line improvements in which we take it, the same class of C.I. • pipe will be used, we feel that the City should take this pipe off our hands for the same prioeaae we paid for the same laid down in Port Townsend, to -wit: $1.58 per foot. Obtaining permission Mr. Daly addressed the Council on the subject stating that inasmuch as he believed his clients to be inno- cent purchasers that the city should buy the pipe. JONES & CROUTEN FINAL ESTIMATE Mr. Daly made a further plea that the final estimates on the Water Street Imppevoments be allowed and ordered paid so that his clients could make a settlement with ,the material men. Motion to Approve Claims: It was then moved by Councilman Robbins and seconded by Councilman Lafferty that the bills of Jones & Crouten,00vering the final estimates on Water Street .Improvements in the total amount of $3969.69, be allowed subject to assignment to the lien claimants and an absolute release to the City by the said claimants and contractors of all further claims and subject to the approval of the City Attorney and Fi- nance Committee. Upon roll call Councilman Robbins and Lafferty voted in the affirmative and Councilmen Smith and Lammers in the negative. Being a tie vote, the motion was declared lost. Motion to Reconsider: -- After some further discussion and it appearing that the Councilmen voting in the negative did not fully understand that the City was fully protected, it was moved by Councilmen Lammers and seconded by Councilman Smith that the motion be reconsidered. Motion declared carried. Jones & Crouton Claims Allowed: It was then moved by Councilman Robbins and seconded by Councilman Lafferty that the previous motion (to allow Jones and Crouton claims) again be put. Upon roll call all four Councilman present, namely Robbins, Smith, Lafferty and Lammers, voted in the affirmative and motion was declared carried. COAffiUNICATIONS From C. V. Savidge, Lend Commissioner: Communication from C. V. Savidge, Commissioner of Public Londe, was presented and road, asfollowas October 3rd, 1930 City of Port Townsend, Port Townsend, Washington. Gentlemen: We have received an application from Martin Bros., to lease the harbor area ;affront of tide land districts Nos. 19 and 21, and Monroo Street, for an oil dook.
