Applicant is a Washington corporation having its principal place of business in the City of Seattle, County of Ring, State of Washington, and''is empowered under its Articles of Inoorporatio to engage in the business, among other enterprises, of operating a gas plant, and/or gas plants, within the State of Washington and elsewhere. II. It is the intention of your Applicant to distribute and sell gas to industries and inhabi- tants within the City of Port Townsend, County of Jefferson, and in pursuance of such intention your Applicant desires the granting to it, it successors or assigns, 'the ri ht, privilege and franchise t lay and construct, and to thereafter operate and maintain, repair and/or replace a system of conduit and pipelines, together with such fixtures or appurtenances as"the grantee, or its successors or assigns, may deem necessary or convenient therewith, in, under, along or eoross all public streets, highways and/or alleys in -said city of Port Townsend, for'the purpose of transmitting and/or distri- buting gas,to the public for light, heat, fuel, power or any other lawful purposes. III. Applicant is desirous of having such right, privilege and franchise granted to it, its successors or assigns, for the period of fifty (50) years'from and after the effective date of the Ordinance of your Honorable Body granting such right, privilege and franchise. IV. There is attached hereto, made a part hereof, and marked Exhibit "A" a draft of an ordi- nance granting said franchise. WHEREFORE your Applicant prays that your honorable body will take such steps in the pre- mises as shall be proper and in accordance with Law, to the and that a franchise as herein requested be granted to your Applicant in substantially the form as attached hereto as Exhibit "A". Motion declared carried. v [ _ ORDINANCES AND RESOLUTIONS Emergency Ordinance for court costs: This being the time set for a hearing on the proposed emergency ordinance to appropriate additional funds.for the City Attorneys office and for court expense, the City Clerk read the said proposed ordinance in full for the second reading. Mayor Bangerter then asked if anyone present desired to be,heard,for,or against the said proposed ordinance. No one desiring to be heard it was moved by Councilman Lammers and seconded by Councilman Smith that the third reading be by title only. Upon roll call all six Councilmen present voted in the affirmative and motion was de- clared carried. 11 Third Readings The City Clerk then read the said ordinance by title only for the third reading. Ordinance Passes: It was then moved by Councilman Lammers and seconded by Councilman Miller that said ordi- nance do now pass. Upon roll'oall all six Councilman present voted in the affirmative and motion , was declared carried. Ordiance No. 993e. The following is a full, true and correct copy of said ordinance as passed by the City Council, March 18th, 1930,'approved by the Mayor March 18th, 1930, and published in the Port Town- send Leader March 20, 1930, to -wit: ORDINANCE NO. 993 ''AN ORDINANCE of the City of Port Townsend, Washington, providing for the appropriation of money from the Olympio Gravity Water Fund of said City for the uses and purposes herein set forth, olass- ifying the proposed expenditure and providing an emergency. WHEREAS, there is now pending in the Superior Court of the State of Washington for Jefferson County, two suits at law .wherein,P. J.. McCullem and'Maris McCullem,.his wife, are plaintiffs and , the City of Port Townsend and -Ben Green, defendants, and WHEREAS, the City Council of the City of Port Townsend has contracted with the law firm of I Roberts, Skeel and Holman to act as associate counsel with the City Attorney in defense of said suits, and i WHEREAS, it appears to the City Council that such proposed expenditure is a proper charge against the Olympic Gravity Water Fund, the fund by which the City of Port Townsend operates in its proprietary capacity, and, WHEREAS, there is insufficient money provided in the budget of said fund for the year 1930 to I meet such proposed expenditure, and,
