Motion deola:ted carried. For City Ball Department, to -wit - New rope for flag pole, and to be reeved in flag pole. It was moved by Councilman Miller and seconded by Councilman Peach that the said requisi- tion be granted. Motion declared carried PROPOSED ORDINANCE. Communication re: proposed ordinance (St Johns Hospital). Mr. W. J. Daly Jr., on behalf or the managemen o St Johns Hospital, presented a proposed Or- dinance, together with the following explanatory communication: Port Townsend, Wash. Feby 18, 1930 Hon. Mayor and City Council, City of Port Townsend, Gentlemen: We transmit herewith a draft of an ordinance which we trust will meet with the approval of the council and the City Attorney as to form. The passage of this ordinance will leave the ordinance of vacation passed some time ago complete without restriction. The Council will recall that when the original ordinance was passed there was appended thereto a proviso that a building be completed on that part of 8th Street (Vacated) within two years from date of ordinance. The buil- ding is now completed but our Seattle attorneys have requested that in order that title be perfec- ted the proviso be repealed leaving the vacation standing. We will pay the cost of publishing ordinance and would suggest that the City Clerk be in- structed to have the Leader Company bill us direct for such cost of publication. The said communication and proposed ordinance were referred to the Street Committee and the City Attorney. Councilman Robbins arrives. Councilman Robbins arrived at this time and took his seat. Scott speaks about w_ater_rightaa City Attorney oott now addressed the Council relative to water rights on the Big and Little Quilcene Rivers and Lords Lake, reviewing how the present rights of the city were secured and a history of previous filings. RECESS. It was moved by Councilman Peach and seconded by Councilman Lammers that the Council recess fc about twenty minutes. Motion carried and recess declared. COUNCIL RE -CONVENES, Council re -convened at 9:45 P.M., same date as above, and upon roll call there were present, Mayor Goo. Bangerter, City Clerk C. F. Christian, City Attorney Jes. W. B. Scott, and Councilmen Clark Aldrich, S. V. Peach, W. B. Smith, R. E. Richards, William Lammers Sr., Jacob Miller and Harry W. Robbins. UNFINSIHED,,AND NEW -:BUSINESS. Special Counsel for Damage Suit. Mayor Bangerter informed the Council that suit had been filed against the City for damages in account of the death of George MoCullem and reoommedded that outside legal talent be secured to de- fend the city in the said suit. Council authorizes same. It was moved by Councilman Smith and seconded by Councilman Lammers that the Mayor be author- ized to secure outside legal talent to defend the city in the said suit of MoCullem, at al, against the city. Upon roll call, all seven councilmen voted in the affirmative and motion was declared carried. RE: VACATION OF YEPSUEY ADDITION. Street outlet for C. B. Harding: Mayor Bangerter stated that Mr. C. B. Harding had requested that the city look into the matter of giving him relief in the matter of a street outlet from his property, and the Mayor requested the City Engineer and the Street Committee to investigate the vacation of the Yap Suey Addition, in relation thereto, and to report their findings to the Council. Re: Francis Black Water Service._ Councilman Lammers brought up the matter of a meter on bhe water service of Francis J. Black, and it is understood that the Water Superintendent is to handle the matter in accordance with the City Ordinances. xMRZ1N*NR$8x (See page 437 ,407- Minutes of Feby 18/30 continued ORDINANCES. r 8th Street Vacation. The proposed ordinance submitted by W. J. Daly Jr., and entitled,"An-Ordinance of the City of Port Tovmsend repealing Section 2 of Ordinance- No. 962 entitled "An Ordinance vacating part of 8th Street in the Eisenbeis Addition to the City of Port Townsend," was now taken up and read in full for the first reading. Reading and passage. It was then moved by Councilman Laimners and seconded by Councilman Miller, that the first read ing be considered the second reading and that the .third reading be by title only; Upon roll call all seven councilmen voted in favor thereof and motion was declared carried. The City Clerk then read the said ordinance by title only for the third reading, whereupon it was moved by Councilman Lammers and seconded by Councilman Miller that the said Ordinance do now pass. Upon roll call, all seven councilmen voted in the affirmative and motion was declared oar- ried. The following is a full, true and oorreot'copy of the said ordinance as passed by the City Council February 18th, 1930; approved by the mayor February 18th, 1930, and published in the Port Townsend Leader February 20th, 1930, to -wit: ' ORDINANCE NO. 992. An Ordinance of the City of Port Townsend repealing Section 2 of Ordinance No. 962 entitled, "An Ordinance vacating part of 8th Street in the Eisenbeis Addition to the City of Port Tiansend." The City Council of the City of Port Townsend, Wash., do ordain as follows: Section 1. That Section 2 of Ordinance No. 962 as mentioned in the title of this ordinance, be, and the same is hereby repealed. • Section 2. That this ordinance be published once in the Port Townsend Leader to take effect an be in force five (5) days from and after such publication. Passed by the City Council February 18th, 1930. Approved by the Mayor February 18th, 1930. ATTEST: Dr. George Bangerter, Mayor C. F. Christian City Clerk. ADDITIONAL REQUISITION. Requisition for Police Department: Reverting back to "Requisitions" in the Order of Bysiness, a requisition for the Police Depart ment was presented and read as follows, to -wit: 3 helmets 3 badges Buttons for uniforms. It was moved by Councilman Robbins and seconded by Councilman Peach that the said requisi- tion be granted. Upon roll call, all seven councilmen voted in favor thereof and motion was de- clared carried. ADJOURNMENT.
