HomeMy WebLinkAbout00511396 I 0 Minutes of December 17, 1929 IV That on or about the 17th day of November, 1929, George ..oCullem, deceased, the rdnor son of claimants, was driving a Ford truck in a westerly.direction in the city of Port Townsend fefferson County, Washington, over the highway and street known as "F" Street, and that, without warning, defendant, Ben Green, who was operating a Ford truck belonging to the city of Port Townsend, igligently, carelessly, wrongfully and unlawfully collided with and ran into the oar being driven ,y George MoCullem, deceased, upsetting said car, and turning same over and on the person of said leorge MoCullem, causing his death on or about the 25th day of November, 1929. That the injuries received by said George McCullem, which caused his death, were as follows, to -wit: Traumatism of Chest, Cervical and dorsal vertebrae; Fracture of several ribs; Injury to visceral organ of chest; Extreme pain of entire trunk; Limitation of all motions - upper and lower extremities; Dyspnoea. That by reason of the death of said George MoCullem, claimants,have been damaged in the sum of Thirty Thousand Dollars, ($30,000.00). P. J. J. McCullem and Marie McCullem, husband and wife, and present this, their claim against the city of Port Townsend and Ben Green, in the sum of Sight Thousand, Four Hundred Fifty-five and 75/100 Dollar:, ($8,455.75), for and upon account of the loath of George McCullem, minor son of claimants, and set forth as follows: I That P. J. McCullem and Marie McCullem at all times herein mention were, and they now are, husband and wife, and are the parents of George McCullem, deceased. II That at all times herein mentioned, the city of Port Townsend was, and it now is, a municipal corporation of the third class, and that Ben Green, during all said times was, and he now is the ;rater Superintendent of said city. III That the claimants, P. J. E. earner of Broadway Addition, thence Westerly along South line of Addition 346.4 feet, thence S. 0 degrees' 13' E. 922 feet to "?k intersect North line of Hunts Addition produced Easterly, thence Westerly xr 114 feet to the N. E. corner of Hunts Addition, (N. E. corner Tax No. 541, y thence South along line of Hunts Add. 546.48 feet to point on Northerly line of f4.a c F. Street,thence Northerly along the Westerly line of B. F. Pettygroves f'et Add. 205.48 feet to the N. W. corner thereof; thence Easterly along the nk't Northerly line of G. Street 426.7 feet, thence N. 0 degrees 13' West 1300 �,��,���:�,�• feet to plane of beginning. IV tirW. That on or about the 17th day of November, 1929, George, MoCullem, the minor son of P. J. F. McCullem and Marie McCullem, was traveling along the highway known as "F" Street in a Westerly direc- tion, driving a light Ford Delivery Truck in the -City of Port Townsend, Jefferson County, Washington, when all of a sudden, without yarning, Ben Green, Water Superintendent of the city of Port Townsend, and operating a Ford Truck owned by the said city, wrongfully, unlawfully, carelessly and negligently ran into the car operated by said George McCullem, thereby over -turning said car, and causing the death of said George McCullem on the 25th day of November, 1929. That said George McCullem was a bright boy and a natural mechanic, and able and ;`µ,2YweP` t�py capable of earning for the next two years, the sum of Twelve Hundred Dollars (41200,00)•per annum, M}t�r J°Fff+`�j 1 and for the following three years, and up until said George McCullem was of the age of twenty-one users, was capable of earning and would have earned the sum of Eighteen Hundred Dollars (31800.00) ` per ann&. VI That by reason of the wrongful acts of defendants, claimants expended the sum of Four Hun- '`i''1 dred Five and 75/100 Dollars 0405.75.), for hospital, medicine and doctors' services and the sum of Two Hundred Fifty Dollars, (0250.00), for funeral and buriel expenses. WHEREFORE, claimants, P. J. Said claims were referred to the Finance Committee and the city Attorney. l Examiner's Claim: l ? Claim of the County Auditor in the amount of $39.51 for salary and expenses of Albert Hollander, state examiner, in -connection with the investigation of Port Townsend Water Bond sale, was resented and read. It was moved by Councilman Robbins and seconded by Councilman Poach that the said claim be alloyed and warrant drawn in payment of same. Upon roll call, all five councilmen resent voted in the affirmative, and motion was declared carried.
