May 28th, 1929 To the Honorable Mayor and City Council of the City of Port Townsend, Wash. Gentlemen: You are adviesed that if you find that more than four months have elapsed since J. E. Berkheimer Mfg Co., filed its lien claim in the sum of $3900.000 with the City of Port Townsend, against the money retained by the City, on account of the filing of said claim, due Jas. H. Coyne, on Contract No. 2, Big quiloene River Water Extension Project, and that no suit has been commenced against the City to foreclose said lien claim, you are legally authorized to pay said Jas. H.Coyne, all moneys due him that has been betained by the City by reason of the filing of said lien claim by the said J. E. Berkheimer Mfg Co. Respectfully submitted, Jas. W. B. Scott City Attorney. Action on said matter was deferred temporarily. From Grace Pitcher, re leave of absence. Application from Grace Pitcher, City Treasurer, for leave of absence, was presented and road as follows: Port Townsend, Wash., May 28, 1929 To the Mayor and City Council. Gentlemen: I hereby make application for ten days leave, same to be taken when I can best be spared from my duties. Respectfully, Grace Pitcher, City Treasurer. W. CLAUSEN, STATE AUDITOR By FRED. D. CHESTNUT, CHIEF EXAMINER, Said Letter was ordered filed. DIVISION OF MUNICIPAL CORPORATIONS. ORDINANCES AND RESULUTIONS. Police emergency ordinance. The matter of the proposed emergency ordinance for the creation of 'an additional patrolman for the police department coming on for hearing on this date and it appearing to the Council from the affidavit of the publisher on file, that notice of time and place foY hearing has been given and the Mayor having publicly announced that, after the ordinance having been'. read, any person soul be heard thereon and no objection having been made, now therfore, it was moved by Councilman Peach and seconded by Councilman Robbins that said Ordinance do now, pass. Upon roll call, all six coun- cilmen present voted in the affirmative and motion was declared carried. Copy of Ordinance No. 975. The following is a full, true and correct copy of said Ordinance No. 975 as passed by the Cit Council May 28th, Approved by the Mayor May 29th and published in the Port Townsend Leader May 30th 1929, to -wit: ORDINANCE NO. 975. AN ORDINANCE of the City of Port Townsend enlarg ng the police department of said city by the addition of one patrolman, providing for the appropriation of money from the Current Expense Fund for that purpose, fixing the compensation to be paid and declaring an emergency. WHEREAS, it appears to the City Council of the City of Port 'Townsend that to enable the folic Department of said city to properly function and maintain continuous and efficient operation in the preservation of order, that an additional pattolman be employed by said city and that for such pur- pose it will be necessary that an emergency appropriation be made; that the sum of $690.00 is a reasonable sum to be appropriated for the purpose aforesaid and that such necessity could 'not have been reasonably foreseen at the time of the making and adopting the 1929 budget for the Current Ex- pense fund of said city, and that a public emergency now exists, therefore, The City Council of the City of Port Townsend, Washington do ordain as follows: Section 1. That the Police Department of said City be and the same is hereby enlarged by the addition of one patrolman. Section 2. That the compensation for such patrolmanbe and the same is hereby fixed at the sum of $115.00 monthly. Section 3. that a public emergency is hereby declared and authorized for the appropriation of the sum of $690.00 for the purposes enumerated in Sections 1 and 2 of this ordinance; that the issuance of emergency warrants in said dum of $690.00 is hereby authorized from the Current Expense Fund of said City. bSection 4. That this ordinance be published once in the Port Townsend Leader and to take ,A. r I- I(E c 4 p effect and be in force five days from and after such publication. Mayor Bangerter then announced the arp9 n ent of Roy S. Weppner to the position of patrolman created by. the foregoing ordinance, sefirices tovbdgin.May; 31'st.•: It was moved by Councilman quenell and seconded by Councilman Lammers that the appointment be confirmed. Motion declared carried. Resolution to adopt aupplementary budget. The resolution ntroduced at Us Test session of the Council, budgeting the sum appropriated by Emergency Ordinance No:'972 was again taken up and it was moved by Councilman %uenell, seconded by Councilman Lammers, that said resolution be adopted. Upon roll call, all six councilmen pres- ent voted in favor thereof and motion was declared carried. Copy of Budget Resolution. The following is a full, true and correct copy of said resolution as passed by the City Coun- oil and approved by the Mayor, to -wit: RESOLUTION. WHEREA6, The City Council of the Cry of Port Townsend, by the passage of Ordinance No. 972, has declared a':neoessary emergency for the appropriation and expenditure of money for the City Engineer's compensation and for necessary assistance, labor and material for the Engineer's Depart- ment, and, - WHEREAS, The City Council has appropriated for said purposes, the sum of $3300.00; $3000.00 of said sum to be paid from the Olympic Gravity Water Works Fund, and the remaining $300.00 from the Current Expense Fund, Now, Therefore, HE IT RzwvLVEb, by the City Council of the City of Port Townsend, Washington, that the follow- ing SUP?LEMENTaY BUuGET, appropriating said sums, be, and the same is hereby adopted, to -wit: CURRENT EnPENSE FUND. J. Daly, Deputy City Attorney. W. J. SADLER a pointed Cit En ineer, Plumbing Inspector, etc. Mayor Bangerter han appo nted Mr. W. J. Sadler as City Engineer and to also act as Plumbing Inspector, Electric Wiring Inspector and Building Inspector. Upon motion of Councilman Quenell seconded by Councilman Peach, said appointment was confirmed by vote of the City Council. UNFINIoIiEu AND NEW BUSINESS. Aronson application granted. Councilman Robbins reported that he had investigated the site in the street where fIx. Aronson desired to erect a garage and reported in favor of the application. He then moved, seconded by Councilman Lammers, that the portion of the street required for the location of the said garage be leased to the said Aronson at a consideration of $1.00 per year and that the building permit be granted. Upon roll call, all six councilmen present voted in favor thereof and motion was declare: carried. RECESS VOTED. It was moved by Ccuncilman Peach and seocnded by Councilman Robbins, that the Council recess for one-half hour. Motion carried and recess declared. Councilman Aldrich arrived during the recess. I RE -CONVENED AATER RECESS. The City Council re -convened after recess at the hour of 11:30 p.m. and upon roll call there were present Mayor George Bangerter, City Clerk C. F. Christian, W. J. f)aly Jr, representing City Attorney Scott, and Councilmen Clark Aldrich, S. V. Peach, IV. B. Smith, Edw. Quenell, Wm. Lammers, Jacob Miller and Harry W. Robbins; Mayor Bangerter presiding. Coast Service Co. application granted. Reporting on the application of the Coast Service Co., presented at the preceding @@salon, Councilman Lammers Moved, seconded by Councilman Smith, that said application be granted provided that the sidewalk area, 12 x 20 feet southerly from the Water btreet line be also concreted, and that the concrete sidewalk on Water Street be cut under the direction and supervision of the City Ehgineer. Upon roll call, all seven councilmen voted in the affirmative and motion was declared carried.
