and that the Mayor and the City Clerk
be authorized to issue warrants upon the proper
funds in pay-
ment of some. Upon roll call, all six councilmen present voted in favor thereof

execute warrants upon the proper funds in payment of same. Upon roll call, all six councilmen
present voted in favor thereof and motion was declared carried.
A. H. PACKARD SPEAKS RE: RIGHT-OF-WAY.
Mr. A. H. Packard was now introduced 'and advised the Council that a tentative agreement had
been reached with the County authorities to acquire the right-of-way for the pipe line, across 33
tracts of County land, by condemnation proceedings at a stipulated price of $2.00 per tract. He
further stated that agreements had been reached with all but about twenty of.•thecremaining tracts
and that these would be acquired by condemnation proceedings.
In relation to the right-of-way through the county property, Mr. Packard read a proposed res-
olution which would authorize the City Attorney to enter into a stipulationproviding for an agreed
judgment by the Superior Court and it was moved by Councilman Manson and seconded by Councilman
Gerson that the resolution as read by Mr. Packard be adopted. Upon roll call, all six councilmen
present voted in the affirmative and motion was d eclared carried.
The following is a full, true, and correct copy of said resolution as passed by the City Coun-
cil December 4th, 1928 and approved by the Mayor on the same date, to -wit:
R E S O L U T I 0 N.
WHEREAS, Pursuant to authority pnovided in Ordinance No. 947, of the City of Port Townsend,
am
action has been heretofore instituted in the Superior Court of the State of Washington, Befferson
County, to acquire by condemnation certain right-of-way, owned by Jefferson County, Washington, here
inafter described, and
WHEREAS, it is for the best interests of the City of Port Townsend, that the damages incurred
to Jefferson County, by said condemnation be settled by a compromise,
NOW THEREFORE, be it resolved by the City Council of the City of Port Townsend, that: the City
Attorney be and he hereby is authorized to enter into a stipulation with the legal representatives
of said Jefferson County providing that an agreed judgment may be entered by daid Superior Court,
adjudging said right of way to be a public use and further fixing the damages for the taking of
said right of way at two dollars per parcel, the description of said parcels so to be compensated
for beings:set forth as follows; annexed to and made s part of this resolution.
Passed by the City Council December 4th, 1928.

All those portions of Lots 1,2y39,40,41, and 42 of Block 5,, D.T.Denny's Second Addition to
Port Townsend, lying within a strip of land, 35 feet in width, and extending 8.25 feet easterly fr
and 26.75 feet westerly from the center line of the City of fort Townsend'a gravity water supply
line as now constructed across Block 5 of said D.T.Danny'a Second Addition to Port Townsend; also
all portions of Lot 2, Block 7; Lots 2 and 11, Block 21; Lots 1,2,11 and 12 Block 35; and Lot 1,
Block 36 of Phillip's Bay View Addition to Port Townsend; Lot 1, Block 7, Lots 1 and 12, Block 8;
Lots 1 and 12, Block 21; Lots 1 and 12, Block 22; and Lot 1, Block 36 of Eisenbeis Bay View Addi-
tion to'Port Townsend, which fall within a strip of land 18.5 feet in width, lying.8.25 feet west-
erly from and parallel to the center line of the City of Port Tovnsend'a gravity water supply line,
as now constructed across said D.T.Denny's Second Addition to Port Townsend, Phillip's Bay View
Addition to Port Townsend and Eisenbeis Hay View Addition to Port Townsend.
A one-half interest in and to a strip of land 181a feet in width lying 8.25 feet westerly from
and parallel to the center line of the City of Port Townsend's water supply line, as now construct-
ed across Lot 2, Block 7 and Lots 2 and 11, Block 21, of Philliphs Bay View Addition to Port Town-
send, Jefferson County, Washington.
Beginning at the point of intersection of the north line of Section 28, T.30,N., R.1 W. and
the westerly boundary line of the Port Townsend Gravity Water Works System Right of Way; thence in
a southerly direction along said westerly Right of Way line, a distance of 1321 feet more or less,
to a point in the South line of the NEQ of the NM`41 of Section 28, T.30 N., R.1 W.; thence in a Wes
erly direction along said south line to a point in al.line 182 feet westerly from and parallel to
said Right of Way line; thence northerly along a line of 18if
1 feet westerly from and parallel to
said Right of Way line, a distance of 1321 feet more or less, to a point in the north lino of said
Section 28; thence easterly along said north line back to the point of beginning, containing 0.56
acre more or less.
Beginning at a point in the north line of the SE-1. of the SB4 Section 8, T.29 N. R.1 W. which
is North 77b 53' West, 16.75 feet distant from the center line of the proposed water supply line
for the City of Port Townsend, as now located and staked out across said SE4 of the SE4 of Section
8• thence South 120 7' West, parallel to said center line, a distance of 340 feet more or less to
appoint in the south line of the Borth 4 of the IVIV4 of the SE,_ of the SE4 of said Section 8;thence
East along said South line a distance of 20 feet more or less to a point in the westerly line of
the Port Townsend gravity water -works system right of way; thence in a Northerly direction along
said westerly right of way line a distance of 340 feet mobe or less to a point in the North line
of the said SE4 of the SE4 of Section 8; thende West along said North line to the point of begin-
ning containing 0.15 acres more or less.
A strip of land 30 feet in width and extending 15 feet on each side of the center line of pro-
posed water supply line for the City of Port Tonsond as now located and staked out across said N*
of the SE4 of Section 17, said center line being more particularly described as follows: Beginning
at a point in the North line of the NW4 of the SE4 of Section 17 which is West 2250 feetceore or 690
less from the East quarter corner of said Section 17; thence South 36
feet more or less to a point in the West line of the SE4 of said Section'I7, said strip of land co:
twining 0.48 acres more or less.
A strip of lend 30 feet in Wirth and extending 15 feet on each side of the center line of the
proposed water supply line for the City of fort Townsend as now located and staked out across said
Lot 3, Section 17, said center line being more particularly described as follows: Beginning at a
point in the East line: of seld Lot 3, said point being North 2090 foot more or less distant from
the South quarter oornar of said Section 17; thence South 360 19, West a distance of 960 feet more
or less to a point in the South line of said Lot 3; said strip of land containing 0.66 acres more
or less.
