then the Board may assign an interim zone.
Section 5.04 Application of Regulations
A. Except as hereinafter provided, no building shall be erected,
reconstructed, or structurally altered, nor shall any building
or land be used, except in compliance with all the district
regulations established by this Ordinance for the district in
which the building or land is located;
B. The minimum yards or other open spaces required by this Ordi-
nance, including; those provisions regulating intensity of use,
for each and every building hereafter erected or structurally
altered shall not be encroached upon or considered as meeting
the yard or open space requirements or the intensity -of -use
provisions for any other building. In the event of any such
unlawful encroachment or reduction, such building shall be
deemed to be in violation of the provisions of this code and
the certificate of occupancy for such building thereupon shall
be null and void;
C. Where the lot is formed from part of a lot already occupied by
a building, such separation shall be effected in such manner
as not to impair any of the requirements of this Ordinance
with respect to the existing buildings, and all yards and other
open spaces in connection therewith, and no permit shall
be issued for the erection of a new building on the new lot
thus created unless in complies with the provisions of this
Ordinance.
Section 5.05 Continuance of Non -Conforming Use of Buildings. Any
non -conforming building or structure may be continued and maintained
provided there is no physical change other than necessary maintenance
and repair in such building or structure.
Section 5.06 Change of Use. Any part of a building, structure, or
land occupied by a non -conforming use may be changed to a use which
is of the same or of a more restricted nature; but where the use
of a non -conforming building, structure, or land is hereafter changed
to a more restricted classification, it 'shall not thereafter be changed
to a use of a less restricted classification.
Section 5.07 Vacancy; Termination of Non -Conforming Use. Any part of
a building, structure, or land occupied by a non -conforming use, which
hereafter is not so used for a continuous period of 180 days shall
not thereafter be occupied except by a use which conforms to the use
regulations of the district in which it is located.
Section 5.08 Change of Tenancy or Ownership. There may be a change
of tenancy, ownership or management of an existing non -conforming use,
provided there is no change in the nature or character of such
non -conforming use.
