HomeMy WebLinkAbout02331after receipt of such application the Planning Commission shall set a date for a public hearing on the application for variance, which hearing shall be held not later than thirty days from the date of the Planning Commission meeting at which said hearing date is set. The applicant, the Building Official and the City Council shall receive notice of such hearing by mail from the Planning Commission and public notice shall be made by posting in three prominent places in the City for not less than ten days prior to the hearing. The Building official, the applicant and any witnesses called by either of them or by the Planning Commission shall be heard at such hearing, and the general public shall likewise be heard. Within ten days following the conclusion of the public hearing, which may not be continued for ;,more than one week from its commencement, the Planning Commission shall forward its findings and decision to the applicant and to the City Council. If the applicant is aggriev- ed by the decision of the Planning Commission, said applicant may, within fifteen days of the rendering of said decision and the mailing thereof to him, make written application to the City Council for review of said decision, and the City Council, at its next regular meeting after receipt of the application for review, shall set the matter for public hearing within forty-five days from said regular meeting. At said public hearing before the City Council, the Council shall have full authority of review and disposition of the matter, and all interested parties will be heard. The decision of the City Council, after such public hear- ing, shall be binding on the City of Port Townsend and the applicant. Section 4. This ordinance is necessary for the preservation of the health, safety and welfare of the citizens of the City of Port Townsend, and shall take effect upon its passage, approval and publication in the form and manner required by law. - 2 -
