HomeMy WebLinkAbout01489Immediately aeon the entry of a judgment and sentence for the violation of the provisions of this section, it shall be the duty of the Police Judge of the City of Port Townsend to mail to the Director of Licensed of the State of Washington, at Olympia, Washington, a full and complete transcript of his docket page pertaining to the part- icular case for such further action in the premises as said Director of Licenses may take as provided by law. It shall be the duty of the Police Judge of the City of Port Townsend upon the entry of judgment forfeiting the bail given by any person charged with a violation of this section to forthwith mail to said Director a like transcript. In the event such convicted person shall testify that he does not and at the time of the offence charged did not have a current and valid vehicle operator's license, then the Police Judge shall cause Stich nerLUi: to oo oh r:n; d't;lta ta.) .l lJ1`Zb iJ:i :) a motor vehicle without a current and valid operator's license as in this ordinance pro- vided sad on conviction punished as heretofore provided. Section 37. It shall be unlawful for the owner or any other person in employing or otherwise directing the operator of any vehicle upon the public streets of the City of Port Townsend to require or knowingly to permit the operation of such vehicle in any manner contrary to the law of the State of Washington or to the provisions of this ord- trance. Section 36. Every person who commits, attempts to commit, conspires to commit or aids and abets in the commission or any act in violation of this ordinance whether Individually or in connection with one or more persons, or as principal, agent, or accessory, shall be guilty of such offence, and any person who falsely, fraduently, forcefully, or willfully induces, causes, coerces, requires, permits or directs others to violate any provisions of this ordinance is likewise guilty of such offense. CHAPTER SII. E"CROEIIEN T. Section 39. Unless another penalty is in this ordinance provided, every person convicted ot`tge provisions of this ordinance, shall be guilty of a misdemeanor and be punished therefor by a fine not exceeding One Hundred Dollars ($100.00), or im- prisonment in the city jail for not more than thirty (30) days, or both such fine and imprisonment. Section 40. Whenever any person is arrested for any violation of this ordinance which is punishable as provided in the preceding sectioli, the arresting or apprehending officer may prepare in duplicate, written notice to appear in the Police Court of the City of Port Townsend in the City Hall at a time to be specified in said notice. Such notice shall also contain the name and address of such person, the license number of his vehicle, if any, the vehicle operator's license number, if any,and the offiDse charged. The arrested person, in order to secure release, as provided in this section, and when permitted by the arresting officer, must give his written promise so to appear in court by signing in duplicate the written notice prepared by the arresting or apprehending officer. Upon the arrested person's failing or refusing to sign each written promise, he shall be placed and remain in the custody of such arresting or apprehending officer or placed in confinement in the city jail until property tried or sooner admitted to bail. Any person willfully violating his written and signed promise to °t appear in police court, as provided in this ordinance shall be guilty of a misdemeanor 'o= regardless of the disposition of the charge upon which he was originally arresteds 3'0 PROVIDED, a written promise to appear in police court may be complied with by an a appearance by counsel.
