file in the office of the County Auditor, Jefferson County, State of Washington.
The City Council of the City of Port Townsend do ordain as follows:

wharves, building docks, mari..a ways and ;ridirono on Madinon street, comrone-
ing on the south side of Water street between Blocks 5 and 6 of the Original
To•.nsite of Port Townsend, State of Tanl ington; and thence extending in a
southerly direction, including all that portion of Madison street between
blocks 5 and 6 and extending to the inner harbor line or deep water; and that
portion of wort street, south of MY, block 5; All aforesaid lots and blocks
of the Original Tocnsite of the City of Port Townsend, Washington, according
to the duly recorded plat thereof on file in the office of the County Auditor,
Jefferson County, State of Washington.
Section 2. That by an acceptance of this Ordinance the said grantee
thereby agrees upon the request of the City Council of Port Townsend, Washington
to conform said wharves, docks or other structures to the grade of said streets
now established or to be hereafter established, and to allow free wharfage over
any wharf constructed under this franchise to the said City of Port Townsend.
That all the rights granted under this franchise shall be subject to any
erliioting rights under any other franchise or franchises previously granted
affecti-Z said streets and the city especially reserves the right at any tine
hereafter to grant a franchise over, across and along said streets to any
person, co Tany or corporation, for the construction and operati.cn of a rail
road Morena and that all the rights granted in this franchise shall be
subject to -thin reservation. The grantee further agrees to leave the street
open and accessible to the abutting property at all times when requested to
do so by the City of Port Townsend.
Section 3. This Ordinance shall be accepted by the grantee within tt:irty
days after its passage and if :not so accepted shall he void.
Section 4. Thin Ordinance ❑hall be published once in the Port Townsend
L oador and take effect and give force from and after five days from publication.
Section: 5. That for the rights heroin granted the said OLIQTID PILE.

ton, the eum of One Dollar (01.00) per anntm daring the tern: of the said
franchise payable annually in advance; that in case the said grantee or its
assigns shall fail to comply with any or all conditions of this Ordinance, then
and therefore thin Ordinance shall become null rued void ani all rights and
franchises herein granted shell beco:re null and void.
