Erickson, his successors or assigns, shall not have constructed a line or lines of railway upon fhe streets herein mentioned, or have in process of construction such 'line or lines within a period of twenty (20) years from the date of to approval of this ordin- ance, then such street or ­treets ro unoccupied shall be free from the :Franchise rights granted by this ordinance, but such release of any such unoccupied street shall in no wise affect the franchise ri;rhts herein granted as to all other streets herein mentioned.'
