HomeMy WebLinkAbout3285 Regarding the Olympic Gravity Water System Fund and Amending Section 3.04.220 OGWS Transmission Line Fund of the Port Townsend Municipal Code Ordinance 3285 Page 1 of 2 ORDINANCE NO. 3285 AN ORDINANCE OF THE CITY OF PORT TOWNSEND, WASHINGTON, REGARDING THE OLYMPIC GRAVITY WATER SYSTEM FUND AND AMENDING SECTION 3.04.220 OGWS TRANSMISSION LINE FUND OF THE PORT TOWNSEND MUNICIPAL CODE RECITALS: The City Council of Port Townsend finds as follows: 1, The City of Port Townsend signed a water supply agreement with the Port Townsend Paper Corporation that requires both the City and the Port Townsend Paper Corporation to pay a"raw water"rate. 2. The proceeds of the raw water rate will be contributed into a fund that will be used for the operations and maintenance of the Olympic Gravity Water System (OGWS) as well as capital sinking fund for major improvements. 3, This requires modifying the purpose of the OGWS fund to include operations and general maintenance as well as the capital improvements. NOW, THEREFORE,the City Council of the City of Port Townsends hereby ordains as follows: Section 1. Port Townsend Municipal Code Section 3.04.220 is amended as set forth below: 3.04.220 OGWS transmission line fund. The OGWS (Olympic Gravity Water System) transmission line fund is established for the qpeiations anJ eiioral anainto lance of the OQWS an(] to set aside funds for the repair and replacement of the OGWS transmission line. Section ' . Appropriations. All previous appropriations for this fund continue to be appropriated. Section 3. Severability. If any sentence, clause, or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase or work of this ordinance. Section 4. Effective Date. This ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law. Publication of this ordinance shall be by summary thereof consisting of the title.
