Ordinance No. 3228
AN ORDINANCE OF THE CITY OF PORT TOWNSEND, WASHINGTON,
REPEALING ORDINANCE NUMBER III PASSED BY THE CITY OF PORT
TOWNSEND BOARD OF TRUSTEES ON MARCH 2, 1867
WHEREAS, the Washington Territorial Legislature incorporated the City of Port
Townsend in 1861 and established a charter for the City that included an annually elected five-
member board of trustees;
WHEREAS, the City of Port Townsend Board of Trustees passed Ordinance Number III
on March 2, 1867. Ordinance Number 3 forbade the building of any "permanent Indian houses"
from the "Catholic Church to One Hundred and Fifty feet west of Tyler street. (sic)" and
required the Marshal to "notify any Indians . . . they must not erect their mat lodges or tents, nor
build fires within"those limitations. Finally, the ordinance "provides that any white man coming
to the City with Indians may . . . obtain permission for such Indians to camp upon some vacant
lot . . ."
WHEREAS, in the 1870s, the City reincorporated and adopted a new charter with a
council and mayor form of government. Arguably, this reincorporation of the City invalidated
the laws and ordinances of the previous Port Townsend city government;
WHEREAS, Ordinance Number III as enacted on March 2, 1867 is not codified in the
City's municipal code; however, the City wishes to foster good relations with our tribal
neighbors who have requested the City repeal this ordinance;
NOW THEREFORE, the City Council of the City of Port Townsend does ordain as
follows:
Section 1. &1,2 e IeLi The March 2, 1867 Ordinance Number III passed by the City of Port
Townsend Board of Trustees is repealed in its entirety.
Section 2. Sever ibilil . If any clause, sentence, paragraph, section or part of this
Ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction,
such order or judgment shall not affect the validity or constitutionality of the remainder
this Ordinance or Plan. To this end,the provisions of each clause, sentence, paragraph,
section or part of this Ordinance are declared severable.
Section 3. Effective Date. This Ordinance shall be effective five days following
publication of this Ordinance or a summary thereof.

ADOPTED by the City Council of the City of Port Townsend, Washington, at a special
business meeting thereof, held this 10th day of June 2019.
