AN ORDINANCE VACATING A PORTION OF THE 30th STREET RIGHT-OF-WAY
NORTH OF LOTS 1, 2 & 3, BLOCK 20, HASTING'S THIRD ADDITION; AND
ESTABLISHING AN EFFECTIVE DATE

Grantor: City of Port Townsend, a municipal corporation
Grantees: Ben and Erica Bauermeister, a married couple
Assessor's Parcel Number: 957-902-001, 957-902-002 and 957-902-003
WHEREAS, the Port Townsend City Council previously considered Street Vacation
Application No. LUP 18-025 and following due notice held a public hearing on the application;
and,
WHEREAS, the vacation petition involves a portion of unopened 30th Street right-of-
way lying north of Lots 1, 2 and 3, Block 20, in the Plat of Hasting's Third Addition. The partial
vacation area is 10 feet in width and 180 feet long. In exchange for the vacation area, petitioners
have offered to dedicate 10 feet of new right-of-way to the City along the south property line of
the subject lots. The off-setting dedication lies adjacent to a 20-foot wide alley in Block 20 that
was recently improved by petitioner to City standards as a local access roadway. The new
dedication area is equal in size to the vacation area sought; and
WHEREAS, Council adopted Findings of Fact and Conclusions at the end of their
September 4, 2018 public hearing which conditionally approved the partial street vacation
subject to:

a) Petitioner submitting a Lot Line Adjustment application to merge the vacated
right-of-way into petitioner's adjoining lands,
b) Petitioner executing a Right-of-Way deed to the City for the 10-foot by 180-
foot new right-of-way being dedicated;
c) Relocation of a segment of non-motorized trail in the 30th Street right-of-way
to be outside of the vacation area; and,
d) Preparation of a written determination consistent with the provisions of PTMC
12.20.090 and .100 that documents the equity in values for the lands being
exchanged.
WHEREAS,petitioner has submitted a Lot Line Adjustment (LLA) consistent with
Council's direction which has been preliminarily approved by the DSD Director(City File No.
LUP 18-098). Final approval and recording of the LLA is subject to final City Council approval
and recording of the street vacation Ordinance; and
WHEREAS, a Right-of-Way deed acceptable to the City has now been executed by
petitioners for concurrent recording with the street vacation Ordinance; and,
WHEREAS, the non-motorized trail segment in 30th Street has been relocated to be
outside of the vacation area; and,
WHEREAS, a written determination consistent with City code has been prepared to
document the equal values of the lands being exchanged.
NOW, THEREFORE, the City Council of the City of Port Townsend ordains as
follows:
section) 1 . The following right-of-way is hereby vacated to Ben and Erica Bauermeister.
The southern 10 feet of 30th Street which abuts Lots 1, 2 and 3, Block
20 in the Plat of Hasting's Third Addition as recorded in Volume 1 of
Plats, page 55, Jefferson County, Washington, being a portion of
Section 3, Township 30 North, Range 1 West, W.M.
Situate in Jefferson County, Washington
Section 2. This Ordinance shall take effect upon its passage, approval and publication in the
form and manner provided by law, and after it has been recorded with the
Jefferson County Auditor.

Adopted by the City Council of the City of Port Townsend, Washington, at a regular
meeting thereof, held this 18 of March 2019.
