HomeMy WebLinkAbout052118CITY OF PORT TOWNSEND MINUTES OF THE CITY COUNCIL BUSINESS MEETING OF MAY 21, 2018 CALL TO ORDER The Port Townsend City Council met in regular session on the 21 st day of May 2018. Mayor Stinson called the meeting to order at 6:30 p.m. ROLL CALL Councilmembers present at roll call were Pamela Adams, David Faber, Robert Gray, Amy Howard, Michelle Sandoval, Ariel Speser, and Deborah Stinson. Staff members present were City Manager David Timmons, Planning Director Lance Bailey, Planning Manager Judy Surber, and City Clerk Joanna Sanders. CHANGES TO THE AGENDA The addition of an Executive Session with no action pursuant to RCW 42.30.110(1) (g)) to review the qualifications of an applicant for public employment. Mayor Stinson noted there would be no public hearing on Item A, Ordinance 3200 Related to Taxation, Adopting a Multi -Family tax Exemption Program until the hearing could be properly noticed. COMMENTS FROM THE PUBLIC Public comment Justine Gonzalez -Berg spoke about the Port Townsend School District's letter to the City urging the filing of an amicus brief. Julia Cochrane asked for a moment of silence on the passing of Alyssa Reed. She urged Council to work on meeting the needs of young people who often do not have adequate support. Barbara Morey spoke about homelessness in Jefferson County and two recent deaths of women. She urged passing a Declaration of Housing Emergency. Rick Jahnke reiterated his previous written comments on annexation and against utility tax on water. He urged moving forward with fire annexation, fully levying the General Fund for $900,000, and reducing the utility tax proportionately. CONSENT AGENDA Approval of Bills, Claims and Warrants City Council Business Meeting May 21, 2018 Page 1 of 4 Vouchers 159780 through 159842 in the amount of $872,626.18 Vouchers 159849 through 159992 in the amount of $384,224.82 Vouchers 568 and 569 in the amount of $436.75 Electronic Fund Transfers in the amount of $1,386,607.50 Approval of Minutes: April 2, April 9, and April 16, 2018 Appointment of Councilmember Representative to the Jefferson County Mental Health and Substance Abuse Advisory Committee (City Clerk note: Ariel Speser was approved for this assignment) Tasking Administration and Advisory Boards to Coordinate the Review of Enabling Legislation (Clerk note: This confirms Council's agreement to task the Library Advisory Board, Nonmotorized Transportation Advisory Board, Parks Recreation and Tree Advisory Board, and the Arts Commission to coordinate with staff to review their enabling legislation, and to forward to the Ad Hoc Committee any recommendations that may develop from their review.) Resolution 18-028 Appointing an Interim City Manager Motion: David Faber moved to approve the consent agenda as written. Amy Howard seconded. Vote: motion carried unanimously, 7-0 by voice vote. PUBLIC HEARING Ordinance 3200 Related to Taxation; Adopting a Multifamily Tax Exemption Program, Designating Residential Target Areas, Adding a New Chapter 3.15 "Multi -Family Tax Exemptions" to the Port Townsend Municipal Code Mayor Stinson noted this item would be rescheduled for a public hearing in July. City Manager David Timmons reviewed the noticing requirements and recommended reviewing the designated areas. If needed, Council could task the Council Ad Hoc Committee on Housing to review designations. Planning Director Lance Bailey reviewed packet materials and gave a broad review of the residential target areas as shown on the map. He responded to questions and comments about the criteria used for designating the areas. There is no conflict with approving this ordinance prior to or in conjunction with the subarea plan. The uses in the subarea plan, if approved, would likely include a higher density than currently allowed. He agreed to check RCW 84.14 on the requirement for including both the eight-year and twelve-year programs and confirm the definition of rehabilitation. He noted rehabilitation would typically be the addition of four or more units or be new construction. Public Comment: City Council Business Meeting May 21, 2018 Page 2 of 4 Debbie Jahnke spoke in support of the ordinance in general. She cautioned any opening of the Logan Street right of way which is part of the Area 6 Map around Bishop Park. She referenced Resolution 99-003. During deliberation, there were several concerns that few would take advantage of the twelve-year exemption. A question was whether we could cap the number of eight-year exemptions and/or cap the amount of market rate housing. There was a desire to know about any limitations on the redevelopment of the Sea Breeze mobile home park. In general, there was agreement with the criteria used. There was no particular interest in researching potential changes in PTMC Chapter 3.13 and no specific changes to the residential target areas. Ordinance 3202 Related to Interim Land Use Regulations in the Vicinity of 6th and 10th Streets and Rainier Street and Discovery Way; Extending the Interim Regulations Adopted in Ordinance 3176 and extended by Ordinance 3192 Mayor Stinson read the rules for the public hearing. There were no financial or property interests to disclose in connection. There being no public comment, Mayor Stinson closed the public testimony. Planning Director Lance Bailey gave the staff report on another extension of the interim land use rules. He noted that a draft subarea plan would be brought forward to the Planning Commission in June. The public hearing was closed. Motion: Pamela Adams moved to approve waiving Council Rules and approving Ordinance 3202 Related to Interim Land Use Regulations in the Vicinity of 6th and 10th Streets and Howard Street and Discovery Way; Extending the Interim Regulations Adopted in Ordinance 3176. Amy Howard seconded. Vote. motion carried unanimously, 7-0 by voice vote. UNFINISHED BUSINESS Ordinance 3198 Amending the Critical Areas Ordinance Codified in Chapter 19.05 of the Port Townsend Municipal Code and Corollary Amendments to the Shoreline Master Program; Completing the 2016 GMA Periodic Update Planning Manager Judy Surber gave the staff report and responded to questions about critical drainage corridors. There was no public comment. Motion. David Faber moved to approve Ordinance 3198 Amending the Critical Areas Ordinance Codified in Chapter 19.05 of the Port Townsend Municipal Code and Corollary Amendments to the Shoreline Master Program, Completing the 2016 GMA Periodic Update. Pamela Adams seconded. Vote: motion carried unanimously, 7-0 by voice vote. NEW BUSINESS - NONE PRESIDING OFFICER'S REPORT City Council Business Meeting May 21, 2018 Page 3 of 4 Mayor Stinson reported on attending the Road Map to Washington's Future related to the Growth Management Act. She also met with the State auditors today on the risk assessment. CITY MANAGER'S REPORT Mr. Timmons reported on the following: - State Audit has begun - Status of the Water Street project, including landscaping that has begun - June 4 Council Meeting is likely to be cancelled - Receiving a June invitation to represent U.S. City Managers at an event in Oslow, Norway - City is following Port breakwater and School projects SUGGESTIONS FOR NEXT OR FUTURE AGENDA, REGULAR MEETING AND/OR STUDY SESSION Mr. Gray would like to see an alternative enforcement mechanism to turning off water for utility customer nonpayment. EXECUTIVE SESSION At 8:03 p.m., the meeting went into Executive Session for 20 minutes pursuant to RCW 42.30.110(1)(g)) to review the qualifications of an applicant for public employment. At 8:23 p.m., Council came back into open session.
