Home My WebLink About3199 Related to Utility Rates; Amending the Water and Sewer Rates; Amending the Low-Income Utility Program Criteria, Amending Chapters 13.01 and 13.05 of the Port Townsend Municipal Code, and Establishing an Effective DateOrdinance 3199 Page 1 of 2 ORDINANCE NO. 3199 AN ORDINANCE OF THE CITY OF PORT TOWNSEND RELATED TO UTILITY RATES; AMENDING THE WATER AND SEWER RATES; AMENDING THE LOW- INCOME UTILITY PROGRAM CRITERIA, AMENDING CHAPTERS 13.01 AND 13.05 OF THE PORT TOWNSEND MUNICIPAL CODE, AND ESTABLISHING AN EFFECTIVE DATE RECITALS 1. In 2015, Council adopted Ordinance 3142, which revised the Water, Sewer, and Stormwater Utility rates, and which implemented a capital surcharge on Stormwater customers. 2. In 2016, Council adopted Ordinances 3145 and 3147, amending the eligibility criteria for the participation in the City's Low -Income Utility Program. 3. In 2017, Council adopted Resolution 17-001, authorizing the City Manager to enter into an agreement with FCS Group for a Water and Sewer Rate Study. As a result of that study, staff recommends implementing the water and sewer base rates and water and sewer capital surcharge rates in order to meet ongoing operating, maintenance and capital needs of the utility. 4. In 2018, the Finance and Budget Committee evaluated options for expanding the criteria for participation in the City's Low -Income program and recommended changing the criteria for low-income participants from 125% of the federal poverty income level to 150% of the federal level, with no recommended change to the current low-income senior and disabled persons criteria (200% of the federal level). NOW THEREFORE, the City Council of the City of Port Townsend do ordain as follows: Section 1. Amendment. In Section 13.01.020B of the Port Townsend Municipal Code ("PTMC"), the definition of "low-income" is amended to read as follows: "Low-income" means a person who has a total current annualized household income from all sources of 125150 percent or less of the poverty level based upon total household size using poverty level calculations established by the state of Washington for Jefferson County or by the federal government if state calculations are not available. Section 2. Amendment. Effective January 1, 2019, the first paragraph of PTMC Section 13.05.030 is amended to read as follows, and the water rate tables in PTMC Section 13.05.030 are amended to include the rate table as shown in Exhibit A. Existing rates are repealed as new rates set by this Ordinance take effect: Ordinance 3199 Page 2 of 2 13.05.030 Monthly water rates. The following monthly rates shall be charged by the city and collected by the finance director for the use and furnishing of water service, all such rates and charges to be made and paid on a monthly basis. These rates will be for water usage starting on January 1, 24162019, and billed in subsequent months: Section 3. Amendment. Effective January 1, 2019, the first paragraph of PTMC Section 13.05.040 is amended to read as follows, and the sewer rate tables in PTMC 13.05.040 are amended as shown in Exhibit B. Existing rates are repealed as new rates set by this Ordinance take effect: 13.05.040 Monthly sewer rates. Effective January 1, 2416 2019, the following monthly rates shall be charged by the city and collected by the finance director for the use and furnishing of sewerage service, all such rates and charges to be made and paid on a monthly basis: Section 4. Severability. If any provision of this Ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to other persons or circumstances is not affected. Section 5. Effective Date. This Ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law. The new rates shall go into effect on January 1, 2019. Adopted by the City Council of the City of Port Townsend, Washington, at a meeting thereof, held this 7th day of May, 2018.
