HomeMy WebLinkAbout1934 Lease a Portion of San Juan Avenue and 10th Street to the Port of Port TownsendORDINANCE NO. iq3~ AN ORDINANCE AUTHORIZING EXECUTION OF LEASE OF PORTIONS OF SAN JUAN AVENUE AND 10TH STREET TO THE PORT OF PORT TOWNSEND THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS: Section 1. The Mayor and City Clerk are here and hereby authorized and directed to execute a lease of That portion of San Juan Avenue lying between Sims Way and the South boundary of Tenth Street, and That portion of Tenth Street lying between Haynes Street and the East boundary of San Juan Avenue, to the Port of Port Townsend, in consideration of the said Port of Port Townsend leasi~ to the City a tract of land North of Sims Way and South of Kah Tai Lagoon for park purposes, for a period of thirty years. Pursuant to RCW 35.24.300, the street lease shall be for a period of ten (10) years, with renegotiation of rents each five (5) years, and on the understanding that failure of the City to renew such street leases during the thirty year term of the Port lease shall be grounds for termination of the said lease by the Port for park purposes. Section 2. This ordinance shall take effect upon its passage, approval and publication, and the lease shall not be executed prior to fifteen days from the first publication of this ordinance.
