AN ORDINANCE AMENDING ORDINANCE NO. 790
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, WASHINGTON IN
REGULAR SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS:
Section 1. That Section 1 of Ordinance No. 790 be and the
same is herebv amended to read as follows:
"Section 1 Unlawfu~ ~iqging of str'eets. It is unlawful for
any person, firm or corporation, not an officer of or in the
employ of the citv, to dig uo any of the streets of the city,
for the purpose of making sewer, gas, water or other utility
connections therein, or for the purpose of laying sewer,
water or other utilities therein or for the purpose of
repairing the same, or for any other purpose whatsoever, until
such person, firm or corporation shall have deposited with
the city clerk a one year maintenance bond in the amount of
$500°00 for each and every such purpose for which it is
intended to dig up such street or streets as a guarantee
that such person, firm or corporation will place the street
or streets to be affected in as good condition for travel
as the same were in before such improvement or improvements
were made, and to maintain such street condition for a
period of one year after acceptance bv the Public Works
Department. Ail such street restoration shall be made in
conformance with the rules and regulations issued by the
Public Works Department. Any person, firm or corporation
which shall default in any particular in fully complying
with this section shall be held liable along with bond
surities."
Section 2. That Section 2 of Ordinance No. 790 be and the
same is hereby amended to read as follows:
"Section 2 Deposit. Such bond shall be returned by the clerk
to the person making the same upon notification from the
Public Works Department to the clerk stating that such street
has been placed in proper condition, and has been properly
maintained for one year, but in case such street has not
been placed in proper condition to the satisfaction of the
Public Works Department within three days after such improvement
has been made, the Public Works Department shall put such
street in proper condition for travel and the cost thereof
shall be assessed against said bond."
Section 3. That this ordinance shall be published once
in the Port Townsend Weekly Leader, and shall take effect and be
in force five (.5) days after such publication.
