AN ORDINANCE PERTAINING TO AND ESTABLISHING SETBACK REQUIREMENTS FOR BUILDINGS AND REPEALING ORDINANCE NO. 1602, SECTION 2: AMENDING ORDINANCE NO. 1625, SECTIONS 2.15, 2.106, 2.108, AND ADDING NEW SECTIONS WHEREAS,-*public hearings have been held by the Planning Commission and the*City Council as required by the ordinances of the City of Port Townsend, now therefore THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS: Section 1. Section 2 of Ordinance No. 1602, 1970, codified as Section 16.04.110 of the Port Townsend Muncipal Code, is here and hereby repealed. Section 2. Section 2.15 of Ordinance No. 1625, 1971, codified as Section 17.08.075 of the Port Townsend Municipal Code is here and hereby amended to read as follows: 17.08.075. Building Line. "Building Line" means the line of that face, corner, (eoo6) or ~ part of a building nearest the property line, including by way of example but not limited to all cornices,, architectural appendages, exterior balconiest decks and similar projections beyond the main foundation line of a building, but excluding the top roof or roof overhang of building~, and excludina sidewalks, driveways and patios on ground level. Section 3. Section 2.106 of Ordinance No. 1625, 1971, codified as Section 17.08.530 of the Port Townsend Municipal Code is here and hereby amended to read as follows: 17.08.530 Yard, rear. "Rear yard" means an open space ex- tending from thirty inches above the general ground level at the rear lot line to the (ma~) building line and including the full width of the lot to its side lines. Section 4. Section 2.108 of Ordinance No. 1625, 1971, codified as Section 17.08.540, is here and hereby amended to read as follows: . 17.0~.~r4Q Yard., side. "Side yard" means an open space extend- ing from thirty inches above the general ground level at the front yard to the rear yard and from the (me~) building line to the side lot line. Section 5. There is here and hereby added to Ordinance No. 1625, 1971, a new section 3.04B, to be codified as Section 17.20.030 in the Port Townsend Municipal Code, as follows: 17.20.03Q. Setbacks and Minimum Yard Requirements. Notwith- standing any other~ordinance or provision of this Code, all set-~" backs (yard requirements) shall be measured from the lot line to the building line, as defined in Section 17.08.075 of this Code, PROVIDED HOWEVER, that the roof or eaves of a roof of a building may extend beyond the building line a maximum distance of two (2) feet into the applicable minimum yard area. Section 6. There is here and hereby added to Ordinance No. 1625, 1971, a new Section 3.04C to be codified as Section 17.20.040 in the Port Townsend Municipal Code, as follows: 17.20.040 Construction and Permits. From and after the effective date of this ordinance, no building permit shall be issued and no building shall be constructed on any tract, lot or site in the City unless the building is situated on such tract, lot or site in conformance with the requirements of Title 17 of this Code and any other applicable provision of law. Section 7. This ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law.
