HomeMy WebLinkAbout082916 CITY OF PORT TOWNSEND MINUTES OF THE SPECIAL SESSION OF AUGUST 29, 2016 CALL TO ORDER AND PLEDGE OF ALLEGIANCE The Port Townsend City Council met in special session on the 29th day of August 2016 in the Council Chambers at 540 Water Street. Mayor Deborah Stinson called the meeting to order at 6:30 p.m. ROLL CALL Councilmembers present at roll call were Pamela Adams, David Faber, Robert Gray, Catharine Robinson, Michelle Sandoval, Deborah Stinson, and Amy Howard. Staff members present were City Manager David Timmons, City Attorney Steve Gross, Public Works Director Ken Clow, City Engineer David Peterson, Senior Planner Judy Surber, City Clerk Joanna Sanders, and Police Chief Michael Evans. David Faber arrived at 6:33 p.m. PUBLIC HEARING Ordinance 3154 Relating to Comprehensive Planning; Adopting the 2016 Comprehensive Plan Update; Amending the Comprehensive Plan; and Amending Titles 17 and 18 of the Port Townsend Municipal Code in Connection Therewith (Continued from August 15) Mayor Stinson noted this is a continuation of the public hearing. Since Council has closed public testimony, there would not be any public comment or testimony at this meeting. Council would proceed with a discussion of proposed changes to Chapter 17.60 (Temporary Uses) related to temporary encampments. Senior Planner Judy Surber noted further clarifications/additions to the errata sheet related to Council's discussion and questions of the Land Use and Housing Elements. Ms. Surber then led Council through a detailed review of the Key Issues regarding temporary encampments (Attachment 22 and Docket Item 24). The ordinance was modeled after the City of Lynnwood. It was listed as a mandatory amendment based on the requirement by state statute (RCW 35.21.295 temporary encampments for the homeless). She pointed out that the Planning Commission recommendations differed from that of staff and stakeholders (East Jefferson Fire Rescue, Jefferson County Environment Health, Port Townsend Police Department and OlyCap). Significant discussion ensued about the Ordinance, Exhibit C and whether to remove "nonprofit organizations" from the definition of"sponsor." Suggested City Council Special Business Meeting -August 29, 2016 Page 1 of 3 additions were to further define a nonprofit and to include in the "temporary tent encampments" definition in Chapter 17.08 "has the capacity and expertise." Staff addressed questions about the differences in permitting requirements for shelters versus encampments. A managing agency might be involved whether the sponsor is a nonprofit or a religious organization. Motion: Robert Gray moved to approve striking the wording "nonprofit organizations"from the definition in Exhibit C to the draft ordinance. Catharine Robinson seconded. Vote: motion failed, 1-6 by voice vote, with Pamela Adams, David Faber, Catharine Robinson, Michelle Sandoval, Deborah Stinson, Amy Howard opposed. During continued discussion of Key Questions on Temporary Encampments, staff responded to questions about whether cars would be an allowable shelter under tent encampments; the possibilities for attaching a maximum density per size of the camp or facilities; and limiting the maximum number of residents for any new sponsor or managing entity until they have demonstrated the capacity. There was also consensus to amend PTMC 17.60, page 4, item M "... shall be on site and on duty...." Motion: Michelle Sandoval moved to approve revising the maximum number of residents at a temporary tent encampment from 50 to 30. Robert Gray seconded. Vote: motion carried, 5-2 by voice vote, David Faber, and Amy Howard opposed. Staff addressed Council questions about setback distance in the draft Ordinance 3154 amending PTMC Chapter 17.60 Temporary Encampments and specifically the reasons for including the amendment as part of the update. Staff explained the process of reopening public testimony. At 8:03 p.m., the meeting recessed for the purposes of a break. At 8:10 p.m., the meeting resumed. City Engineer David Peterson reviewed the housekeeping items in the Transportation Element as reflected on the docket. He noted this element includes a new introduction, new challenges and opportunities, revised policy and direction statements, and incorporated resiliency and climate change issues. Staff explained the preference to use current standards as established in manuals versus including the details in the plan. Following discussion, there was consensus to the following changes in the Transportation element: Page 6-16, Policy 1.5, keeping the word "lower" versus "reduced" Page 6-17, Policy 2.6, Support the development of regional bicycle and pedestrian transportation corridors that link regional commercial, recreational and employment areas. Page 6-28, Policy 5.11 to spell out the acronyms. Designate the classification of bicycle, pedestrian and other paths.... and spell out acronyms Page 6-29, Policy 5.14. Replace "nonmotorized" with bicycle and pedestrian from first sentence and delete second sentence. Page 6-33, Transit Services Inventory, second paragraph to read: Jefferson Transit connects passengers to major hubs including Kitsap Traneit in Dnul6be, Clallam City Council Special Business Meeting - August 29, 2016 Page 2 of 3 Tr-anc it. in Coir aim and Mason Counties Transit in Rrinnnn Page 6-34, Policies 7.6, 7.7, and 7.8, search replace throughout document Haines "Street" Park and Ride with Haines "Place" and search for "park and ride transit facilities" to make more general. Page 6-37, Ferries Inventory, revise sixth sentence to add "during periods of low tide." Page 6-40, Commercial Historic District, replace "Main Street" with "Main Street Program" Page 6-41, Policy 9.5, delete parenthetical phrase at the end of the policy (ems., Park aR d Rode facility, hTGYGIe 6 etc-.) Page 6-42, Policy 9.13, remove duplicate "in neighborhoods" Page 6-49, Table 6-4 (should be Table 6-3) Following Table 6-14 is a list of prierity nrnionts identified :n the Non-Motorized Transportation Plan Priority Projects for 2010 City Council updates project priorities on an annual basis. Thee nrniocts are Search and replace Local Improvement District to check capitalization Add definition of"complete streets" and "narrow streets" to the glossary There was some discussion about Council's continued review of the remaining elements (Utilities, Capital Facilities and Economic Development) as well as a review of remaining questions on elements where there has been tentative agreement. Staff offered to meet with councilmembers individually to address specific questions. It was noted that special meetings may be needed. Motion: Catharine Robinson moved to approve continuing the public hearing to September 6, 2016 for continued deliberation and tentative action. Pamela Adams seconded. Vote: motion carried unanimously, 7-0 by voice vote.
