AN ORDINANCE VACATING McCLELLAN AVE BETWEEN 8T~
STREET AND 9TH STREET AND VACATING 8TH STREET
BETWEEN McCLELLAN AVE. AND HANCOCK STREET ~*
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND~...:~~·
SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS:
Section 1. That portion of McClellan Avenue lying between
the southerly margin of 8th Street and the Southerly margin of
9th Street be and the same is hereby vacated.
Section 2. That portion of 8th Street lying between the
Westerly margin of McClellan Avenue and the Westerly margin
of Hancock Street be and the same is hereby vacated.
Section. 3. That the City reserves and retains in the vacated
street, for itself, the public and its successors and assigns,
an easement and the right to exercise and grant easements over,
above and upon said street~ donsisting of twelve (12) feet
running six (6) feet on either side from the centerline of each
of the aforesaid vacated McClellan and 8th Streets, for the con-
struction, repair and maintenance and use of any and all public
utilities and services and the operation thereof.
Section 4. That this ordinance shall only take effect
upon the recording with the Auditor for Jefferson County, State
of Washington, a duly executed Property Use and Development
Agreement for a Planned Unit Development pursuant to the Ordinances
of the City of Port Townsend, by and between the City of Port
Townsend and Dujardin Development Company, a Washington corpora-
tion, which agreement shall be recorded prior to the recording
of this Ordinance and. the publication hereof; and upon its pas-
sage, approval and publication in the form and manner provided
by law.
