AN ORDINANCE OF THE CITY OF PORT TOWNSEND PERTAINING TO
THE ACCEPTANCE OF DONATIONS, DEVISES OR BEQUESTS TO THE
CITY OF PORT TOWNSEND AND AMENDING SECTION 3.04.230 OF
THE PORT TOWNSEND MUNICIPAL CODE.
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR
SESSION ASSEMBLED DO ORDAIN AS FOLLOWS:
Section 1. Ordinance Number 1933, Sections 1, 2, 3, 4,
and Section 3.04.230 of the Port Townsend Municipal Code, are
here and hereby amended~ to read as follows:
(a) Pursuant to RCW 35.21.100, the City ~ hereby authorized
to accep~ any money or property donated, devi. sed or bequea'~-hed t~'-
it'-'a~d ~ c~rry out the terms 0Y-the don'atilo~.¢' dev~'~ 0'r .beqUest
if within the powers ~ranted by law~ If no terms or conditions
are attached to the donation, devise or beq~.~.s~.,. %he city may expend
or use the same. for any municipal purpose.~ ~cept~.ce of any~.~0nation,
devise or bequest by the City shall be by resolution of the Cit~ Council.
~ (b) There is established a fund. to be knowh an~ desilgn'ated t~e
"memorial fund" wherein shall be deposited all sums of money coming
to the City and its various departments, boards and commissions
by reason of gift, bequest or other voluntary gratuitous transfer
from any person or entity~
~ (c) The appropriation and disbursement of sums from the
memorial fund shall be made in the same manner as other funds of
the City are disbursed.
~e~ (d) Funds coming into the memorial fund may be and shall
be accepted and managed in accord with any conditions and terms
imposed by the donor in making the gift.
~ (e) Funds in the memorial fund may be invested and reinvested
by the clerk-treasurer in the same manner as may be u~ilized ~or
the investment of other city funds.
~(f). The_ City's Clerk-Treasurer is hereby authorized and
directed to ~estab!ish such other funds and accounting pr0c~dqrg, s

donation~ devise or bequest, in accordance with laws of %he State
of Washington and requirements Drescribe.~ by.the office of the
State Auditor for Washington
Section 2. This Ordinance shall become effective upon its
passage, approval and publication in the manner provided by law.
Read for the first, second and third times, passed by the
City Council for the City of Port Townsend and~-approved by %he
Mayor on this 16th day of July, 1985.
