AN ORDINANCE REGULATING PAWN BROKERS AND SECOND-HAND
DEALERS, INCORPORATING AND ADOPTING RCW 19.60 BY
REFERENCE, PROVIDING FOR PENALTIES AND ENFORCEMENT,
AND AMENDING AND REPEALING PRIOR ORDINANCES.
THE CITY COUNCIL. FOR THE CITY OF PORT TOWNSEND, IN REGULAR
SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS:
Se.__ction 1~ Pursuant to RCW 35.21.180, authorizing adoption
of state codes by reference, the City of Port Townsend adopts
by this reference, as though fully set forth herein, the following
Sections of the Revised Code of Washington, as now or hereafter
amended, and the same Shall be effective upon. the effective date
of this Ordinance:
(a) 19.60.010 D~finitions
(b) 19,60.014 F~xed place of business required
(c) 19.60.020 DUty to record information
(d) 19.60,040 Report to chief law enforcement officer
(e) 19.60.045 Duties upon notification their property is
reported stolen
(f) 19.60.050 Retention of property by pawnbrokers-in-
spection
(g) 19.60.055 Retention of property by second-hand dealers-
inspection
(h) 19.60.060 Rates of interest and other £ees-sale of
pledged property
(i) 19.60~061 Pawnbrokers-sale of pledged property limited-
written document required for transaction
(j) 19.60.062 Attorney fees and costs in ac%ion to recover
possession
(k) 19.60.066 Prohibited acts-penalty
(1) 19.60.085 Exemptions
SectiqD .~.,. Violations of this ordinance pursuant to Section
l(k)_~, shall be punishable by a fine not to exceed $5000.00 or
imprisonment in jail not to exceed one year, or by both such fine
and imprisonment.
S,ection_ ~_.. For purposes of this ordinance, "law enforcement
officer" shall include any police officer' of the City of Port
Townsend. ~. ~olitical subdivision shall include the City of
Port Townsend.
Section 4,. The Chief of Police for the City of Port Townsend
shall enforce the provisions of this ordinance within the juris-
diction of the City. Any and all reports, notices, and other
documents required hereunder shall be filed with the Chief of
Police, where required to be filed with the Chief of Police or
the County's Chief Law Enforcement Officer under the provisions
of the Revised Code of Washington adopted by re~erence above.
~.~ction..~.~ All interest and other fees allowed or to be
charged shall be as set forth in Section ~ of this Ordinance.
Sect~9~._~ Ail persons or entities regulated by this ordinance
shall also obtain any' other license, permit, and pay any other
tax or fees which may' be required by applicable law or by other
City Ordinances.
~ecti~n~]~.. The following ordinances or parts o£ ordinances
are here and hereby repealed:
(a) Section 1 of Ordinance 873, and Section 5.28.010 of
the Port Townsend~Municipal Code.
(b) Section 4 of Ordinance 873 together with Section
5.28.040 of the Port Townsend Municipal Code.
(c) Section 5 of Ordinance 873 together with Section
5.28.050 of the Port Townsend Municipal Code.
(d) Section 6 of Ordinance 873 together with Section
5.28.060 of the Port Townsend MuniCipal Code.
Section .8. The ordinances and laws repealed by this ordinance
are repealed except with respect to rights and duties which matured,
penalties which were incurred, and proceedings which will begin
prior to the effective date of this ordinance.
~ection 9 If any provision of this ordinance or its
application to any person or ci. rcums%ances held invalid, the
remainder of the ordinance, or the application of the provision
to other persons or circumstances is and shall not be affected
thereby.
Section_ lQ. This ordinance shall take effect upon its

passage, approval and publication in the manner provided by
law.
Read for the First, Second, and Third times, passed by the
City Council for the City of Port ~ownsend, and approved by the
mayor of the City on July i6, 1985.
