AN ORDINANCE AMENDING ORDINANCE
NO. 1903 AS AMENDED
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION
ASSEMBLED, DO ORDAIN AS FOLLOWS:
Section 1. Section 3 (A) of Ordinance No. 1903 as amended by
Ordinance No. 1931, 1970, and No. 2004 is further amended to
read as follows:
"Upon any telephone business there shall be levied a tax equal to
(6v~%) 6.12% of the total gross operating revenues, excluding
revenues from intrastate toll, derived from the operation of such
businesses within the City of Port Townsend. Gross operating
revenues for this purpose shall not include charges which are
passed on to the subscribers by a telephone company pursuant to
tarriffs required by regulatory order to compensate for the cost
to the company of the tax imposed by this ordinance.
"Telephone Business" means the business of providing access to a
local telephone network, local telephone network switching services,
toll ser¥ices, or coin telephone services or providing telephonic,
video, data, or similar communication or transmission system. It
includes cooperative or farmer line telephone companies or associa-
tions operating an exchange. "Telephone Business"does not include
the providing of competitive telephone service, nor the providing
of cable television service.
"Competitive Telephone Service" means the providing by any person
of telephone equipment, apparatus, or service, other than toll
service, which is a type which can be provided by persons that are
not subject to regulation as telephone companies under title 80 RCW
and for which a separate charge is made."
Section 2. This ordinance shall take effect January 1, 1986, upon
its passage, approval, and publication in the form and manner pro-
vided by law.
Read for the first, second, and third times, passed by the council
and approved by the Mayor on October 1, 1985.
