AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE
CITY, ORDINANCE 1625, AND AMENDMENTS THERETO, BY
PROVIDING FOR CONDITIONAL USE PERMITS FOR HOTELS
AND INNS, AND PROVIDING FOR EFFECTIVE DATES AND
CONTINUANCE OF NON-CONFORMING USES.
WHEREAS, the Planning Commission for the City of Port
Townsend has duly held public hearings upon an application to amend
the zoning ordinance of the City, and
WHEREAS, the City Council, acting as Board of Adjustment,
has also duly conducted public hearings concerning the proposed
amendments, and
WHEREAS, the Planning Commission and the Board of Adjustment
made Findings of Fact and recommendations for certain amendments to
the zoning code for the City of Port Townsend, now therefore
THE CITY'COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION
ASSEMBLED, DO ORDAIN AS FOLLOWS:
Section 1
Section 3.03_of Ordinance No. 1625, as amended by Ordinance
Nos. 1686 and 1761, all codified as Section 17.16.010 of the Port
Townsend Municipal Code, are each here and hereby amended, by amend-
ing the table of permitted uses,-f6r hotels and inns, to read as
set forth in Exhibit A attached hereto and by this reference incor-
porated herein fully as if set forth in full, to provide that hotels
and inns and similar uses otherwise not listed in this table should
require a conditional use permit.
Section 2
This Ordinance shall not apply to the following hotels, inns
and similar structures, properties or uses:
a. Those which are in actual use and operation as of the
effective date of this Ordinance.
b. Those which, ~lthough not actually being used or operated
as such, have a valid city business license as of the effective date
of this Ordinance, and which are in fact used and operated no later
than 180 days following the effective date of this Ordinance.
c. Those properties or structures for which a building permit
has already been issued, or for which a building permit has been
applied for and which is subsequently issued, for the purpose of
establishing such a structure or use, even though the structure or
use may not be established until after effective date of this Ordinance.
d. Those uses and properties which previously operated as
such a use, but which are temporarily not operating as a hotel, inn
or similar use due to repair or renovation, provided that such
structures or properties are so used as a hotel, inn or similar
operation within 180 days of the effective date of this Ordinance.
Section 3
This Ordinance shall take effect upon its passage, approval
and publication in the form and manner provided by law.
