AN ORDINANCE VACATING TWO ALLEY RIGHTS-OF-WAY LYING WITHIN
BLOCKS 3 & 4 OF LEARNED'S SECOND ADDITION TO THE CITY OF PORT
TOWNSEND; ESTABLISHING CONDITIONS TO THE STREET VACATION;
AND ESTABLISHING AN EFFECTIVE DATE

WHEREAS, the City Council for the City of Port Townsend has considered Street
Vacation Application Nos. LUP07-033 (Tache and Lesta A. Bentley; Bruce L. Chase) and
LUP07-123 (Luise Muller) and following due notice held public hearings upon the
applications; and
WHEREAS, the vacation requests involve two sections of alley right-of-way, one
lying in Block 3 and the other in Block 4 of the Learned's Second Addition. Each alley
segment is approximately 275 feet in length and 19 feet in width; and

WHEREAS, the City Council for the Ciry of Port Townsend separately adopted
Findings of Fact and Conclusions concerning the alley vacations on June 29, 2007 and
February 19, 2008; and
WHEREAS, the Council's Findings and Conclusions approved in concept the
proposed vacations subject to petitioners paying for an appraisal of said alleys and paying
100% of the appraised value of the land; and
WHEREAS, the Council's Findings and Conclusions also conditioned the vacation
approvals upon petitioners submitting Lot Line Adjustment applications to merge the vacated
alley into petitioner's adjoining lands; and
WHEREAS, petitioners have now paid full appraised value of the subject alleys to the
City and have submitted Lot Line Adjustment applications, which have been processed and
preliminarily approved by the DSD Director subject to final City Council approval and
recording of the alley vacation Ordinance,
NOW, THEREFORE, the City Council of the Ciry of Port Townsend ordains as
follows:
Section 1. Subject to the conditions in Section 3 of this Ordinance, the following right-of-
way is hereby vacated to Tache & Lesta A. Bentley and Bruce L. Chase.
That portion of the 19-foot wide alley lying within Block 3, Learned's Second
Addition to the City of Port Townsend, according to the plat thereof recorded in
Volume 1 of Plats, page 48, records of Jefferson County, Washington.
Section 2. Subject to the conditions in Section 3 of this Ordinance, the following right-of-
way is hereby vacated to Luise Muller.
That portion of the 19-foot wide alley lying within Block 4, Learned's Second
Addition to the City of Port Townsend, according to the plat thereof recorded in
Volume 1 of Plats, page 48, records of Jefferson County, Washington,
Section 3. Vacation of the aforementioned alley rights-of-way is conditioned on the
following:
a. Petitioners shall adhere to all conditions of their respective Lot Line
Adjustments, which received preliminary approval by the City DSD
Department on April 1S, 2008 (File No. LUP08-019) and April 18, 2008
(File No. LUP08-037). These Lot Line Adjustments merge the vacated
right-of-way into petitioners adjoining lands via the filing of a Record of
Survey and a Statement of Intent. The Record of Survey and Statement of
Intent shall be filed with the Jefferson County Auditor concurrently with the

recording of this street vacation Ordinance. The petitioners shall pay for all
fees associated with recording the above documents.
Section 4. This ordinance shall take effect upon its passage, approval and publication in
the form and manner provided by law, and after it has been recorded with the
Jefferson County Auditor pursuant to Section 3 of this ordinance.
Adopted by the City Council of the Ciry of Port Townsend, Washington, at a regular
meeting thereof, held this second day of June, 2008.
