Regular Meeting of February 22 , 1990
Roll Call
Mr, Kosec called the meeting to order at 7 :35 p.m. Other members
present were Lois Sherwood, Ron Kosec, Karen Erickson, Alan
Carman, and Bob Grimm. Also present were Kevin O'Neill, Planner,
and Michael Hildt, Planning and Building Director.
II . Reading and Approval of Minutes from Previous Meeting
Ms. Sherwood Moved to approve the minutes from the February 8 ,
1990, meeting. Ms. Erickson seconded and all were in favor.

draft findings and conclusions be adopted with :-the. addition of
the condition that a specific parking plan in conformance with
Ordinance 2175 be approved prior to occupancy of the art and
antique gallery*
The motion carried unanimously -o by roll calf. vote.

Mr. O'Neill explained that the applicant has written in
request of continuation. Mr. Carman moved that the matter be
continued to the second meeting in April. Mr.. Grimm seconded and
the motion carried unanimously.

1. Staff Presentation and Review
Mr. O'Neill distributed a memorandum to the P1 nning Commission
suggesting certain amendments to the draft Findings and
Conclusions he had prepared.
He thanked the applicants and the Park Board for their
cooperative work in presenting an agreed prop al which would
provide for pubic use and enjoyment of the viewpoint, He then
reviewed the application and presented the draft Findings and
Conclusi ns he had prepared for the commission. He explained
that initial concerns from city department heads regarding the
loss of future utility corridors sould be resolved by the
vacation of the interior lot lines.
Mr. Grimm asked if the department heads have approved. Mr.
O'Neill responded that Mr. Stricklin, Public Works Director, gage
his verbal approval earlier in the day.
2. Public Testimony
The applicant, Robert Rickard, described the rural character of
the subject and surrounding properties and their intent to use
their site in a way which would also enhance the use and
enjoyment of the views by the public. He emphasized that the
status quo is hazardous and frougt with conflict between the
public and neighboring pr perties& He asked for an amendment to
the draft findings and conclusions to use approximate area
calculations until the property has been completely surveyed.
Mr. Grimm asked if a range of plus or minus 10 percent would b
adequate. ,
Mr. Rickard stated that that would be a reasonable range. He
continued to describe the unobtrusive fence desirede

Peter Albrecht spoke In support. He stated that he and Lynn
Anderson had recently acquired adjacent property.
Lynn Anderson added that the applicants have admirable concern
for the trees and public access to the bluff.
Committee report Kosec/M Dole
Mr. Ksec asked if the City Council has approved the plan of land
exchange. Mr. O'Neill stated that the Council -will address the
proposed exchange as a part of their consideration of the
application and the Planning Commission's recommendation,
Ir. Kosec stated that he appreciated the work of the applicants
and the Park Board. He asked if the Commission wished to await
further response of the public works department,
Mr. Carman stated that he sees no problem if the interior lot
lines are vacated, and could come to a recommendation based on
. O'Neill's statement of Mr, etricklin's verbal approval .
Ms, Erickson asked that written approval of department heads be
obtained before consideration by the City Council ,
Mr, Carman moved that the staff draft Findings and Conclusions be
adopted with the amendments presented in Mr. 'Neill's memo, and
with the addition of an amendment to Condition n , 2 that the
area of 24,000 SF be an approximate amount, plus or minus 1
percent.
The motion carried unanimously by roll call vote, 5-0 .

Mr. O'Neill explained that the City Attorney has asked him t '
recommend that the hearing be postponed because the city is still
in negotiations for acquisition of the property..
Mr. Carman moved that the Matter be continued- to April 26, The
motion was seconded by Mr. Grimm. Mr. Gram asked that the
hearing be renotified.
The motion carried 5-0 by roll call vote.
V. New Business
Mr. O'Neill passed out a memorandum listing all scheduled
hearings and new applications received.

He also distributed a letter from Philip Hassrick, requesting
further delay in hearing his application.
Ms. Erickson asked if he may continue to use the property for
multifamily housing contrary to the zoning code. A discussion
ensued. r, O'Neill explained than there are other property
owners who have joined the application.
Mr. Grimm moved that the request be denied and staff notify the
applicants that the matter will be heard as scheduled on March 8,
1990. Ms. Erickson seconded and the motion carried unanimously
y voice vote, - .
Mr. Grimm asked that he be excused for vacation from March 1
through April 15. The commission granted the request.

Re: City Council Update
Date: February 22 , 1990
At the City Council meeting on February 20, 1990 , the Council
took the following actions regarding land use cases:
-Conditional Use Application 8911-06 , Dornan
} The Council approved the application. The applicants
requested that the number of units be reduced from three to
. two, so amendments were made to the conditions to reflect
this change.
-Conditional Use Application 8911-05, Variance Application
8912-08 , Discovery View Associates
The Council approved the conditional use permit. Amendments
were made to the conditions to reflect revisions which were
made to the site plan based on a meeting held between the
proponent on some surrounding property owners. The Council
also approved the parking variance, but are requiring
reserve parking area of 74 spaces as opposed to the 37
spaces proposed -by the applicant. ,
