Some discussion followed over a proposed wording change for
Finding of Fact number 5.
John Buhler told the Commission that the applicant proposes to
move the house south five feet to allow a -foot northern
setback. The structure would not encroach upon the Sins Way
setback.
Dori Miller, a neighboring property owner, stated that he was in
favor of the variance but, he would like to have a 24 -foot height
limit on all structures and vegetation on the - site and the
adjacent parking strip. He suggested that the height be measured
from the current ground level at the N,W, corner of the subject
property.

condition running with the title of the lard. ,

variance are beyond the control of the applicant. He stated that
he felt the applicants were also requesting a- variance from the
back setback. He also felt a height restriction should be placed
on the property, He suggested a condition rre tricting the total
height to 24-foot maximum height using the N,W, corner of the lot
tas a reference point.
Mr, Tavernakis moved to recommend approval of variance 9003-01,
Marcella Pounce, He recommended that the variance be granted
with the clarification that a 20-foot setback is not required
long the complete length of the property along Sims Way due to
special circumstances created by the topography of the land. He
also suggested that a condition be added to put a height
restriction on the subject property, using the northwest corner
of the subject property as the reference point for measurement,
the maximum height of any structures, additions, appendages or
