HomeMy WebLinkAbout051090 Min Ag ' II of Port Townse Planning Commission 540 Water St. Port Townsend, WA 98368 2061385-3000 Meeting of May 1 , 1990 1, Roll Call Chairman Ron Kosec called the meeting to order at 7:40 p.m, Other members present were Lois Sherwood, Karen Erickson, Jinn Taverrnakis, Alan Carman and Bob Grimm. 11. Reading and Approval of Minutes from Precious Meeting Ms. Erickson moved to approve the minutes of the April 26, 1990. Mr, Carman seconded and all were in favor. III. Communications The Commission received a letter from applicant Arne Wilienhag requesting the postponement of street Vacation Appl, 8911-04 , The Commission received an update on recent City Council Actions. The Commission received a letter from Bill Toskey concerning the Sperry/Little Conditional Use Permit Application 8908-01. IV, old Business a. variance 9003- 1 , Marcella Youce 1. Staff Review The Findings of Fact and Conclusions were read into the record. The applicant proposes to construct a single-family residence on property located at the northeast intersection of Jackman street and State Route 20. The applicant proposes to construct the residence with no setback from the Jackman Street right-of-way and a 5-foot setback to the northern property line. 2. Public Comment Marcella Younce, applicant, stated that the slope of the land makes the variance necessary. she also stated that the variance would help to keep the height of the house down to 2-stories. Ms. Erickson asked the applicant if the entire proposed project ill be moved five feet south on the property. • M1* r Planning Commission----May 10, 1990 Page 2 of Some discussion followed over a proposed wording change for Finding of Fact number 5. John Buhler told the Commission that the applicant proposes to move the house south five feet to allow a -foot northern setback. The structure would not encroach upon the Sins Way setback. Dori Miller, a neighboring property owner, stated that he was in favor of the variance but, he would like to have a 24 -foot height limit on all structures and vegetation on the - site and the adjacent parking strip. He suggested that the height be measured from the current ground level at the N,W, corner of the subject property. Cindy Thayer, 81olcomb, stated that the request is a viable one and would protect the view for neighboring home owners. She also requested that a height restriction be set forth in the variance. Ted Simmons, a neighboring property owner, concurred with previous testimony that the height limit should be addressed. Public testimony was closed. Committee Report (Grimm/Tavernakis) Mr. Grimm stated that Mr. O'Neill , former planner, had drafted the Findings of Fact and Conclusions and apparently felt comfortable with the variance and public testimony was in favor of the variance, He stated that the variance could be granted with a 24-foot height restriction on overall height with this condition running with the title of the lard. , Mr. Taverrnakis stated that the circumstances rewiring the variance are beyond the control of the applicant. He stated that he felt the applicants were also requesting a- variance from the back setback. He also felt a height restriction should be placed on the property, He suggested a condition rre tricting the total height to 24-foot maximum height using the N,W, corner of the lot tas a reference point. Mr, Tavernakis moved to recommend approval of variance 9003-01, Marcella Pounce, He recommended that the variance be granted with the clarification that a 20-foot setback is not required long the complete length of the property along Sims Way due to special circumstances created by the topography of the land. He also suggested that a condition be added to put a height restriction on the subject property, using the northwest corner of the subject property as the reference point for measurement, the maximum height of any structures, additions, appendages or Planning commission,--May 10, 1990 Page 3 of vegetation will not exceed 24-feet in height. " Using the overall height and not the definition of height set forth in the 198 Uniform Building Code. Mr. Tavernakis also recommended that Finding of Fact number four be amended to rea " . . •will be setback at least 10-feet r-om State route 20. ..J. 11 and that a second condition be added requiring that a restrictive covenant for a 24-foot height limit be -recorded with the Jefferson County Auditor's Office. Bob Grimm Seconded. some discussion followed over the proposed front and rear property setbacks. The motion passed unanimously. b. Conditional Use 9004-01 , Paul and Cali Greenhalgh 1 , Staff Review + The Findings of Fact and Conclusions were read into the record. The applicants propose to establish a one-unit bed and breakfast inn in an existing residence located at 928 Franklin Street. 2, Public Comment + Paul Greenhalgh applicant stated that he plans to provide two off-street parking spaces. Mr.. Greenhalgh stated that the Bed and Breakfast already exists and that he is attempting to bring the business into conformance with city ordinances by requesting a conditional use. Ms. Sherwood asked for clarification on the parking plan, Some discussion followed. Mr. Greenhalgh stated that there will be someone living in the home but it will not be the applicant. 3 . Committee Report (Erickson/Sherwood) Ms. Sherwood stated her concerns over the parking plan. Mr, Grimm asked the Commission t "When is enough,, enough?" He was referring to the number of bed and breakfast inns in Port Townsend. Some discussion followed over the existing bed and breakfasts and the required parking requirements. The Commission discussed the lack of enforcement toward the installation of the required parking spaces.. Planning Commission--May 10, 1990 Page 4 of Jim Tavernakis suggested the Commission send a communication to the City Council starting the Commission's concern over the enforcement of parking requirements* Mr. Carman suggested listing parking requirements as a condition on Conditional Use Permits. Ms, Sherwood moved to recommend approval of C ndition l Use 9004- 01, Paul and Gail Greenhalgh, adopting the Draft Findings of Fact and Conclusions and adding Condition proposed parking plan shall be constructed, in place and approved by the Planning Director prior to the issuance of a certificate of occupancy. , Erickson seconded. Discussion. Mr. Grimm suggested that a letter accompany the Planning Commission's recommendation to the City Council. The letter should state the Planning Commission's concern for the lack of parking requirement enforcement. Ms. Sherwood stated that the letter should be submitted to the City Council with the application as an explanation of conclusion number five. Ms. Erickson agreed to amend the motion to include sending a letter, A roll call vote was taken and the notion passed unanimously. C. Conditional Use 9004-03 , Bjorn and Gunda Lunde 1, Staff Review The Findings of Fact and donclusions were read into the record. The applicants propose to establish a two-unit tourist home at an existing residence located at 806 Clay Street, Mr, Carman suggested that an amendment be made to Finding of Fact to reflect the amount of street frontage used for driveway access. . Public Comment Gunda Lunde, applicant, stated that the units in question are now used as apartments. Ms* Lunde stated that she would like to continue using a third unit as an apartment. Committee Report (Erickson/Grimm) Ms, Erickson stated that no off-street parking is required. Mr. Carman stated that he would like the applicant to commit -to the submitted off-street parking plan. He stated that the applicants parking plan should be constructed and in place prior to the issuance of a certificate of occupancy r Planning Commission--May 10, 1990 Page 5 of Mr, Grimm stated that if there is space available for off-street parking on the site the spaces should be developed. . Findings and Conclusions Mr, Carman proposed to add a condition number requiring three off- street parking spaces be constructed by the applicant and approved by the Planning Director prior to the issuance of a certificate of occupancy.
