Other members present were Lois Sherwood, Karen Erickson, Sally McDole and Jim Tavernakis. II. Approval of Minutes Ms. Erickson moved to approve the minutes of February 14 , 1991 as written. Ms.. McDol seconded and all were 1 favor. III, Comamuni s ioris - Ikon I . old Business Mr. T ve n kis stated that a letter was received by the commission requesting a continuance for William White. Chairman Kosec told the audience that the hearing would be continued to a later date. Ao Tariance Application, 9011-06, Bill and Sue Maxwell Ms. Erickson asked for a verification on the application number for the variance request. 1. Staff Review Mr* Sepler reviewed the draft findings and conclusions for the va iance application. The applicants have applied for a variance to allow a front porch addition with less than the required setback at 515 VanBuren Street. The draft recommends approval of the variance. 20 Public Testimony Applicant Bill Maxwell stated that he would like the variance to be approved. Mr, Kosec stated a complete notification of the surrounding neighbors had not occurred for the first hearing. Planning Commission tel February , 1991 Page 2 ii Ms. Sherwood stated that the neighbors had been notified this time and they were not present to testify. 3 , Committee Report and Findings and conclusions Ms. Sherwood moved to approve variance application 9011-06 accepting the findings of fact and conclusions as presented by staff. Ms, Mc ole seconded and all were in favor. B. Conditional Use Permit, 9012-03, William White Mr. Beplr stated that a letter had been received from the department of licensing concerning the proct. This letter prompted Mr. White to request a continuance of.- his hearing. Ms. McDie roved to continue the hearing to April 25,, 1991. Ms. Erickson seconded and all were in favor, Subdivision Appl. , 9009-03 , "Parkview" Vantage Homes, bee Wilburn 1. staff Report Mr. sepl.er stated that the original checklist has been withdrawn, revised checklist has recently been received but as yet has not been accepted as complete. Because the revised checklist will have a direct effect can the revision of the plat, this hearing will likely be More general in testimony. Another hearing will be held for the environmental issues under the SEPA process. Mr, Sepler stated that this is a good opportunity to discuss more general issues such as the effect on neighborhood character. 2. Public Testimony Leh Wilburn from vantage Homes, applicant, stated that a number of changes have taken place. The original mitigated DIES has been withdrawn. Changes were made to accommodate the wetland area in the subdivision, and the plat has been redesigned. In the revised plat the wetland is crossed at 90 degrees in one small spot but this will be mitigated. The wetlands issues will be discussed in front f the legislative environmental committee. A'trail system will go all the way around the wetland and an information system will also help to protect the wetlands. Mr. Tavernakis asked ghat the resource on the site was the applicant mentioned, The applicant responded that under current army corp regulations the wetland could just be filled. He has elected to mitigate it because the loss of the wetland would be significant to the community. In the revised plat many of the lots originally in that area have been removed or reconfigured. 1 Planning Commission - February 28 , 1991 Page 3 of Cathy O'Shea stated that the wetland area is larger that 1 . 1 acres as stated by the applicant, No one has really ever addressed the questions on the dedicated right of ways, only easements. O'Shea requested that she be notified for the SEPA hearing. Fancy Scott Roth stated that she had trouble with the original checklist and will comment on the revised checklist when it is made available. Seventy sic lots on this site would be very dense. She stated that Discovery Road can not hold the additional traff ic, along with all the other- development. The access to the site is gained through easements. She stated that an easement is proposed through the water tower property. Ms. Roth stated there is drainage issue on the property. Ms. McDole asked Ms. Moth to show the Commission the location of her property in relation to the project. Mr. Carman joined the Commission at this time. Mr. Tavernakis asked Ms, Roth to clarify her objections, Ms, Scott Roth stated that 76 homes is too Bauch for the area, along with its traffic problems. Mr, Tavernakis asked Mr. Carman where the low point of the proposed site was. Mr. Carman stated that it appeared to be near the northerly portion of the property. Mr, Tavernakis asked where the water- would go. Mr. Carman responded that the drainage would run off the project to the north and into the wetland area. Mr. Kec asked if there was a reduction in lots in the new plan. Mr. Wilburn responded that there would be a reduction but the number was not yet set. He also stated that the drainage will all be accommodated on site. Linda Carson stated her concern for the high density development in low density area. Mr. Tavernakis asked Mr. Carman if Discovery Bay road could be increased. Mr. Carron stated that the road hay a60-foot easement and it now exists at about 40 feet. lir. Tavernakis asked ed ir. Carman if there are any specific requirements for roads in relation to schools. Mr. Carman responded that he did' not know. Kathleen Wilber stated that she awns property in the area and does not want high density in the area. She stated there has already been an increase in the traffic. She also had a concern over the amount of water that will be used in the plat and had a concern about the increased danger of a water shortage. Charlie O'Shea read chapter 6 of the goals and policy of the comprehensive plan. He emphasized the section that states that d Planning Commission - February 28, 1991 Page 4 of residential developers should bare costs of development. Ms, O'Shea stated that she had heard Discovery Road could not be widened, Some discussion followed over the possibility of widening Discovery Road. Mr, O'Shea stated that he would like to see the SFPA checklist and the new proposed plat. Mr, Sepler stated that the S PA Checklist and the Subdivision will be available for public review as soon as they are determined to be complete. Mr, O'Hara asked how many other developments Mr. Wilburn has developed. Mr. Carman responded that the Commission is not allowed to loop in to the developers qualifications. Public testimony was closed. Some discussion followed about the legislative/environmental committee meeting and the noticing of the review of the SPA checklist, Mr. epler responded that the neighboring property owners would be notified. Some discussion followed. Mr. Tavernais stated that the accuracy of the topography map was questioned. Mr. Wilburn stated that when the maps were superimposed the maps were off. Mr, Wilburn stated that the maps are being revised to tape care of all of these concerns. Mr, Carman stated that a motion for continuance would include further testimony. Mr, Carman moved to continue the hearing to May 91 1991 where additional testimony will be taken. Ms. Sherwood seconded. The applicant agreed to the revised date. The Commission agreed the meeting date would not be Moved up for any reason. Mr, Tavernakis asked if the hydraulic study will be accurate. Applicant responded that it would. A Grote was taken and all were in favor of the motion, Street vacation Application, 9101-08 , Mire Marson/Lee Wilburn 1 . Staff review The applicants request the vacation of Magnolia Street formerly offtt Street) south of Cook Avenue. There was some discussion over why no comments were made by the fire department. The Public Worts review process was discussed, The applicant stated he could respond to these issues during the public testimony. Planning Commission - February 28 , 1991 Page Ms. Mciole stated that the lot on the corner looked unsafe. . Public Testimony Mr.. i lburn stated that he originally asked to open the street, but after discussing it with the Public Works Department decided to ask for a street vacation. Mr, Wilburn has a street permit from the Public Narks Department to open an alley to the west with all the requirements for fire and access addressed in the street permit. Mr. Wilburn explained the proposal by showing the Commission on map, Mr, carman asked the applicant if he could show the street development permit to the Commission. The applicant stated he did not have it with him but could bring it another time. Erickson stated that the fire department has always had to give an approval before a street vacation was approved. Ms, Erickson stated she had difficulty finding the site, Some discussion followed over the location of the street. Mr, Wilburn described the site. dome discussion followed over access to the proposed lots. Mr, Taernakis asked how the setbacks would be affected. New Business Mr, Sepler explained that a text amendment to ,,the short plat code is proposed.
