ROLL CALL Chairperson Ron Kosec called the meeting to order at 7 : 30 p.m. Members present were Alan Carman, Karen Erickson, Sally McDole, and Jim Tavernakis, II . APPROVAL of MINUTES Approval of minutes from meetings dated March 28th and April 11, 1991. It was moved by Chairperson Ron Kosec and seconded by Karen Erickson to approve the minutes. All were in favor. III . COMMUNICATIONS Current Mail The Commission received a letter dated April 18 from Josephine Reynolds regarding her Conditional Use Permit. A hearing date was discussed. Mr. Sepler said that because this was merely an extension of a precious application, the Commission probably didn't have to operate on a first-come, first-served, basis, Mr. Carman moved to have the hearing on June 27th. Ms. Erickson seconded. All were in favor. A letter from the Olympic Environmental Council was received. IV. OLD BUSINESS ' A-* Street vacation #9101--w08, Mike Marson, Mr. Koen reminded the Commission that this hearing was continued from the meeting of February 28 . 1. Staff Presentation and Review Mr, Sepler directed the Commission ' s attention to the revised documents in their packets . The applicants request a vacation of that portion of the entire 60 foot Width of platted and unopened Magnolia Street. Mr, Sepler reviewed the Draft Findings and Conclusions for the Commission, and said in conclusion that planning staffinembers recommend that this Street Vacation be granted as conditioned, with the following conditions; 1 . A certified copy of the ordinance vacating the street shall be recorded with the City Clerk, and the office of the Jefferson County Auditor. Upon receipt by the City of a l l fees and compensation required, pursuant to Section 12 - 20 - 120 of the Pori Townsend Municipal Code, the street vacation shall be cancelled and become automatically mull and void within one year after City Council action if said fees have not been paid. k t f i -foot easement for utilities shall be maintained along the center line of the vacated portion of Magnolia Street. . All improvements ents stipulated by Street Development Permit #91010 shall have been completed prior - tovacation f the street. 4 . This street vacation shall not become effective until restrictive covenants executed and recorded by the City , Attorney setting forth all conditions of this permit to (unclear) and be binding upon the land. Mr. Sepler then reviewed the snap for the Commission. Some confusion arose over the correct names for streets in this area. Mr. Marson addressed the Commission, hoping to correct any confusion about proper names for streets, saying that confusion had probably arisen because he had received another street permit in that area recently. Nis. Erickson and Ms. Sherwood said that they have the wrong Public Works List. Ms . Erickson asked a question about traffic fl.low and street development. Mr. Carman asked Mr. Marson if the hammerhead would severely impact development if it were extended to 24 feet. Mr. Marson said that it would just be giving the City more of his property, but if there was a reason for it, it might be considered. Mr. Ta ernakis asked a question about access. Mr. osec opened the floor to public testimony. The applicant spoke first, saying that they had been working on the application for about six months to get everything together, and that it had been approved by almost everyone. No one else chose to spoke for or against the application. Mr. Kosec closed the floor- to public testimony, and roved on to the Committee report, presented by Ms. Erickson. Nis. Erickson said that she had no problems with the application, or with Public Works approval. She had no further questions, and said that all the things the Commission had requested be done, were done. Nis. Erickson moved that the Commission recommend Application #9101-08 to City Council, Findings and Conclusions as written by staff . Sally McDol.e seconded. h 'roll call vote was taken, and all were in favor. A, conditional use Permit , 9102-m01, Iran Deering 11 Staff Presentation and Review Mr. Carman mentioned that there was a confiit because he had become an adjacent property owner. He said that he felt no personal conflict. He told the Commission that he would excuse himself if anyone saw a conflict. No one opposed his presence during the hearing. . Sepler proceeded with the Staff Report. The applicant proposes to establish a bed and' breakfast in an existing single-family home located at 1208 Franklin Street on the corner of Franklin and Fillmore Streets, in an -III zoning district. Three guestrooxs are provided in the residence, along with an apartment over the garage. An additional basement room is proposed. Mr. Sepler reviewed Draft Findings and Conclusions for the Commission, and presented a discussion on parking for the proposed use. Mr. Sepler, speaking for Planning Stafftembers, recommended that the application be granted conditioned, subject to the following conditions: 1. Prior to the issuance of a Certifidate of occupancy for the additional guest room, the premises shall be inspected by the Washington State Fire Marshal. .I Proposed use shall ' comply with the proposed Findings of Fact and conclusions and conditions. Ih case of any .conflict, the Conditions shall prevail over Findings, and interpreting or applying the same. This conditional use permit i shall not become effective until a restrictive covenant is entered and recorded by the City Attorney, setting forth all the conditions of this permit to run with and be binding upon the land. Mr. Sepler- said that one question was whether or not one additional unit, as proposed in the application, was reason enough to require the conditional use process. The case was sent to the City Attorney, who did determine that it was enough of a substantial change to merit the conditional use process. Ii Mr. Tarernakis asked a question about the parking requirement. r I' Mr. Kosec opened the floor to public testimony. The applicant, Joan Deering, spoke first. She said that she had spoken with at least five of her neighbors, and no one showed any disagreement with the proposal. She clarified that they wouldn't be building any additions, but would be remodeling their basement, and the xoom would be in that space. i i W Helen ll n, a neighboring property owner, spoke in f av r of the application. She said that the Deerings have operated a guest house in the neighborhood for several years, and that they do not bother the neighbors, they come in quietly, they leave quietly, and it is a pleasure to see them cone. Ivo one spoke in opposition to the application' . . Kosec closed the floor to public testimony, and moved on the committee report. Ms, McDoie said that in reading Keith Harper"s letter, the one family who had objected previously didn't appear, which was a good sign to her that there wasn't much objection at all. She said that she was in f ar of the application. Ms. McDoie roved to accept Conditional use Permit Application #9102-01 a conditioned, and that she accepts the finding.s of fact and conclusions and conditions. Ms. Erickson seconded. A roll-call vote was taker-, and e' pprl was unanimous. V. NEW BUSINESS Mr. Sepler talked about applications that will be coming before the Commission in the next few meetings, such. as the Arterial Streets Plan, the Dignan Street Vacation Application, and Zoning Text Amendment. Mr. Sepler discussed the Elks rezone, and interesting conditions that the application presented. He said that the SEPA application is currently reaching the review stage. A brief discussion on traffic plans and impact fees ensued. vll . ANNOUNCEMENTS The Petersen Street vacation Application was moved to June 27 . Ms, Erickson and Ms. Sherwood said that they would not accept the Elks Environmental. Checklist on the grounds that the information submitted is incomplete to base a decision on. M . McDole and Ms . Sherwood pointed out errors in the Checklist, and also said that Mr. Robison had signed the Environmental Checklist under Review for Completeness. They feel that it is not complete. Mr. Kos c asked the Commission if they would like to schedule Ted Simmons to spear on Earthquake Preparedness. { Mr. Tavernakis suggested that it didn't seem necessary to take up Commission time to learn about Earthquake Preparedness, but that maybe Mr. Simmons could schedule a separate session, to which City Council members could be invited, along ;,with the Historic Preservation Commission or anyone else who would be interested in coming, Katherine Johnson was delegated to arrange the session. Mr. Sepler announced that on May 8 , from 7 : 00 to 10: 00, there would be a charrette in the Community Center to design the Gateway Triangles, Ms. Erickson volunteered to be the Planning Commission representative to the olarrette, Mr. Tavernakis moved to adjourn the meeting, 4nd Ms. McDole seconded.
