Minutes of Meeting of May 30, 1991
I. ROLL CALL
Chairman Ron cosec called the meeting to order at p.m. Other
members present were Lois Sherwood, Karen Erickson, Sally 1 cDole
and Jim Tavernak is. Jim Roberts asked to be excused. Alan Carman
will be entering the meet later.

A. Street vacation Application, 3101-01, Virginia Dignan
1. Staff Review (Hildt
Mr. Hildt reviewed the draft findings of facts and conditions, The
applicant is proposing to vacate a portion of Landes, Oxford and
Kuhn Streets, Mr. Hildt said the Fire Department and Public Works
Department have reviewed the application and dick not find the
street vacation to impose a negative public impact,
Mr. Hi idt then reviewed the proposed conclusions and recommended to

the commission that the street vacation be granted with six
conditions, as stated in the Draft Findings of Facts, Conclusions
and Conditions.
Nis. Erickson asked Mr. Hildt if the application was properly
notified. Mr, Hildt said he had a list of six names of property
owners within 200 feet of the proposal. Mr. Hirt said all six
were not i f i eco, and he read the s i x names,

Virginia Dignan, applicant, said the area is zoned for rural use
and is currently used for a crop growing business and maintaining
livestock, and she would like to continue using the property in
this fashion.

Ms. Sherwood said that after reviewing the application, and noting
the conditions Stade by the Public Works Department, she would life
to move that the application be approved.
Ms. Erickson seconded the motion.
A brief discussion ensued. Roll was called and all were in favor.
B. Subdivision Application, 9009-03 , Parkvier vantage Homes

Mr. Hildt said that a Draft A and Draft B of the Findings of Facts,
Conclusions and conditions have been prepared.,. Mr. Hildt said that
Mr. Lee Wilburn, applicant, has a revised plat that indicates the
reduction of some lots, The plat shows a prevision date of May 30,
1991.
(Alam Carman entered the meeting at this time'. 7: 55 p.m. ]
Mr. Hildt thea began to review Draft A. He said the proposal i
for a 74 single family subdivision on a 30. 8 acre parcel. Mr.
Hildt said he suggestd that finding #2 be charged to indicate that
the lard in the area of the proposal is sparsely :developed as
opposed to vacant.
Mr. Hildt stated that a wetland of approximately 35, 000 to 40, 000
square feet exists on the property. He said an initial Mitigated
Determination of Non-Significance MDNS ' was issued by the City
Council in November-, 1990. The council later withdrew the MDNS in
light of information about a significant wetland in the area. He
said the applicant thea submitted a new environmental checklist for
which the council issued a new MDNSO
Mr, Hildt reviewed Draft B. He said that the findings of fact are
identical in Drafts A and B. He went on to read the conclusions of
Draft B and the recommendation to deny the application,
Mr. Kosec asked that under conclusion number two, the wording
should be ref lected to indicate the possibility of lower density
rather than the project would definitely cause lower densities.
Ms. Sherwood suggested that item number seven of draft B be
reworded to reflect that rather than this plait being unplanned, it
is the city' s growth plan that is lacking.
Mr. Hildt said the change would be made by staff.

Nancy Scott Roth, a neighboring property owner, said she is
concerned about the possibility of 13th Street becoming an arterial
street, and that this would be the result of this proposal.

2 . Public Testimony.
Lee Wilburn, president of vantage Howes and the applicant,
addressed the commission. Mr. Wilburn said that many more lots
could have been platted on the land, but they incorporated open
space and a buffer for the wetland rather than developing these
areas. He stated that the smallest lot on the subdivision is 7, 200
square feet and some lots are as big as half an acre.
Mr. Wilburn said that they have completely avoided the wetland area
and have come up with a mitigation plan for the wetland, This
mitigation plan has been accepted by the City Council and the
Department of Ecology, he said.
Mr. Wilburn said the total open space is 8.7 acres. He said open
space coupled with streets totals almost half of the area being
dedicated to the public for one use or another. The wetland will
have information signs in aiding in its preservation.
Mr. Wilburn said that his proposal incorporates features which go
far beyond the requirements of the ordinance, such as a 30 foot
buffer around the development and careful consideration about the
placement of streets.
Mr, Losec asked if anyone else wished to speak in favor of the
application.
Mr.. Jim Guthrie, a► land owner of five acres adjacent to the
proposal, said he supports the Parkview Plat, He said he thinks it
is important to have planned developments.
Mr. Guthrie said that he has been a builder and has worked with Mr.
Wilburn. He said he has been impressed withr' , Wilburn's work and
his attempts at preserving the open spaces in the area.
Mr. Kosec asked if anyone wished to spear against this application.
Mr. Fred Hauser, a near-by property owner, said he understands that
Mr. Guthrie is financially involved in this proposal and would like
that noted.
Mr. Hauser said that Mr. Wilburn said he would not be building on
the wetland. He said this 'is not entirely true. He said a portion
of the wetland, lots 17, 18and Dahlia Street, have been deleted

from the plan. He said the State Department :I o f Ecology made the
sane determination. He also said he would like it noted that the
author of the environmental checklist is not present at tonight'
meeting.
Mr. Hauser said he is curious as to whether the City is not
promoting development in this area by opening the streets in this
area.
Ids. Kathy O'Shea, a nearby property owner, said the State
Department of Ecology, in their letter dated May 20 and addressed
to Brent Shirley, recommended a buffer of 100 feet. Ms. O'Shea
said that this project must be considered ' in light of other
significant developments in this area: Towne Point, Eldridge'
development and the proposed Elk's Club project. She said this
area is not a platted area and could have as , few as six homes on
it. She said this development may not be Considered dense for
uptown, but it is considered dense for this area.
. O'Shea said that Counoilmember Jean Canfield said at the
Legislative Environmental meeting that Ivy Street would never g
through. She said that we are not able to count on that right now.
Nancy Scott Roth said that the density is not appropriate for this
area. Ms, Roth said she does not think it is appropriate to
approve this project at this time in light of. not having a master
plan. She said 't puts the city in the position of planning around
Mr. Wilburn.
Ms. Roth said she understands that the city has identified this
area site for a reservoir. Mr. Hildt 'Confirmed this. Ms.
Roth said she is Concerned that the Parkview homeowners will speak
against having the reservoir in this area.
Ms, Roth also said that neighborhood concerns are much more than
vehicular traffic, as stated in the Draft Findings of Facts and
Conclusions, Draft B.
Nis. Roth said that she thinks the second access should be provided
before the third phase, as is planned now, After phase two, 61
homes will have been built and only one access provided, Ms. Roth
also asked how the city would finance partial payment of the pump
station. She also said a bond ' f $50, 000 far the wetland
mitigation measures was far too little. She 'also said she thinks
that Covenants, Conditions and Restrictions seldom work.
Mr, Charles O'Shea, asked what bind of road beds were proposed.

Mr. Hildt said that the roads to Hastings would have to be paved.

Mr. Carman said he would first like to ask the applicant about the
alleged I'missing part's of the wetland.
Mr. Wilburn said the wetland was tagged, but then some unknown
person removed almost all of the tags. He said the area was
retagged and thea a survey was done. Mr. Wilburn said that any
wetland area will be protected in his wetland mitigation plan, and
he will make changes if they are necessary or- required.
Ms. Sherwood said she would prefer that less sensitive areas be
developed, but is impressed by the level of detail Mr. Wilburn has
given to this area. She said her biggest discomfort is all of the
contingencies of transportation.
. Dr. Tavernakis said he would like to add the condition that after
Phase 1, a north/south access should be made.
More discussion followed concerning access*
Mr. Milburn said that it was staff' s recommendation to build a
north/south access after Phase ll since the houses will be ]wilt
over a several year period and to incorporate it into the city' s
master transportation plan,
Ms. I cDo le said she thinks Mr. Wilburn has followed through on a l l
the requests the commission has made of him.
Mr. Carman said he does not think it is fair for the commission to
require that the owner of the land under develop his/her land when
the comprehensive plan points to the very use the developer is
proposing, Mr. Carman said he thinks Mr.Wilburn has done an
excellent job in developing the property.
Mr. Wilburn briefly described the history of this property,
including the fact that the land was on the market for, 10 years and
no one bought the land. He also said at one time he offered to
sell the property to area land owners at one half the appraised
value of the land and they declined.
Dr. Tavernakis moved that the commission recommend to City Council
Findings of Facts, Conclusions and Conditions, Draft 2 with the
changes discussed at this meeting.

brief discussion ensued over the use of pesticides near the
wetland. Mr. Wilburn said he would incorporate the prohibition of
using pesticides on lots A & B abutting the wetland.
Nis. Sherwood said she thinks the subjective language (may not
contribute to the community character. . . ) should be changed. Mr.
Carman suggested to end the sentence after the word "Comprehensive
plan. "
Dr. Tavernakis would like to add to his motion that staff delete
the subjective language in J7.

Discussion.
Additional discussion of the elements of the plat followed.
After some discussion over the requirement of restricting the use
of pesticides, Dr. Tavernakis dropped that element of his motion.
Roll was called and all were in favor.
C. Text Amendment, Summary Short Plat

Mr, Nildt reviewed the proposed change for decisions on summary
short plats to be transferred from the public works director to the
planning director.

Ms. McDole moved to adopt the change. Roll was called and all were
