ROLL CALL Chairman Ron Kosec called the meeting to order at 7:40 p.m. Other members present were Lois Sherwood, Jinn Tavernaks and Jim Roberts. II. APPROVAL OF MINUTES: Minutes of June 27,, 1991 Mr, Roberts moved to accept the minutes. Ms. Sherwood seconded the motion and all were in favor. III, COMMUNICATIONS A. -Current Mail iii. Robison summarized a memo from the State Department o Community Development regarding hosting a planning workshop for the Growth Management Act. IV, OLD BUSINESS A. Gateway Update and Discussion (Robison) Mr. Robison said the Draft Development Plan is being revised to incorporate issues raised during discussions of the Gateway Plan. He said issues that still meed to be discussed include design review and the financing and i l t i plan. ; B. Street vendor ordinance (Harper/Sepler) . 1. Staff Review Harper Sepler Mr. Harper briefly reviewed the draft ordinance. [Mr. Carman entered the meeting at 8: 04 p, . ] discussion ensued over the clarification of the definition of "violation, " penalties, proposed application and monthly fees and parking requirements,, 2 . Public Testimony Planning Commission f Meeting of July 11, 1391 Pace 2 Mr, Craddock Verser, attorney for Michael Beckham, addressed the commission. Mr. Verser said street vendors do ' not clutter city streets and detract from the flavor of Port Townsend, as the draft ordinance suggests, Mr. Verser also questioned the $75 application fee and the $250 license fee and wondered if it actually costs the city this amount. He also suggested that the application should be responded to within 10 days or some other specified time period. Mr, Verser also said that the Historic Preservation Commission had no guidance for reviewing' street vendors businesses. He suggested 10 day notice period to the vendor of any non-compliance before penalties are made. Mr. Vers er also said he had never beard of any other city renting sidewalk space, as proposed in this draft ordinance. He asked where the money would go: building more sidewalks, repairing sidewalks? Mr. verser also said he did not think that the limitation of vending places should be up to the. discretion of the Planning Director and that any parking requi ements be waived. Ms , Margaret Ree said she concurred with Mr, Verser's comments. She also said she objected to the use of the word `moral l in the purpose section of the ordinance. she said sh a did not know of any other business license in the city that required the revelation of any criminal record. she said that criteria should be established if it is to be the City Planner's discretion to determine the product needs of the city. Mr, Dan Tiedermans said the $1. 50 per square foot calculation for rent was far too high. He said he understands that the landlord is responsible for parking requirements if rent is charmed; this means the city would be responsible for the parking. Mr. Michael Beckham, a street vendor, said he wondered how this would affect his situation. He said he thinks the ordinance hinders business. He said he opposes a monthly rent paid to the city. F Mr. Sals Weir said he thinks "hazard" should be defined and it should be clear who determines the hazard. Mr. Beckham said the Health Department has the authority to shut a business down immediately if there is a hazard.. He said this ordinance does not give the Health Department this authority. Ms. Joyce Cox-Webb,, owner of the sidewalk Tours company, asked Keith Harper if her business would need to be franchised. Mr. Harper thought it would. Ms. Cox-Webb said the fees were unfair. She said she objected to the non-refundable application fees and the monthly rental fees. s a y r Planning Commission Meeting of _July 11, 1991 Page Mr, Ted .Scholberg said thinks the ordinance„ is heavy handed and should re-drafted entirely* . Kirby Newman- e a of the Peninsula, Daily News asked if a person pays $75 for' a lottery and loses, does she have to pay again to apply for another spot if s/he loses the lottery Mr. Kieth Harper said that yes, the person would have to pay again, as the ordinance is written now. He added that the ordinance could be changed. Mr. Beckham said he thinks the City Council instead of the Planning Director should make the decision about who is licensed. He also suggested requiring some link between the street vendor and the business in front of which it sits. Mr. Ted Scholb erg said he thinks the Planning Director is the appropriate person to make the decision, but discretionary power should be limited. Holly DeShart asked what background information was used in waiting this ordinance. Mr. Harper said 10 - 12 ordinances were examined. He said it i most simi i 5 Planning Commission _ Meeting of July 11, 1991 Page Mr. Harper- said this ordinance only covers those businesses whose point of sale is on the public right-of-way and not those where the point of sale occurs within a building of an established business. Some discussion followed about display carts. Ms. Sherwood moved that city Attorney Keith Harper make - the revisions the Commission has discussed and present another draft for discussion on August 8, 1991. Mr, Tav rnakis seconded the motion. All were in favor and the motion carded. C, Administrative Authority Ordinance (Harper/Hildt) Mr. Hildt briefly reviewed the intent of the draft ordinance: for the Planning Department to administer some of the routine, minor land use cases. Mr. Harper then reviewed the three drafts of the administrative authority ordinance. r Some discussion f of]owed over why the lann i,n Commission I'd not adopt a similar proposal -in 1988 and if the situation had changed. . Public Testimony Bill Medlicott spoke in favor of the ordinance. He said it has safeguards so that the ordinance would not be abused. He recommended that this ordinance be passed and also recommended that the Planning Commission recommend to the City Council that they. hire an enforcement officer to enforce this and other city ordinances. Ted Scholberg said he thinks this is an excellent ordinance and hopes that it will be passed as quickly as possible. He said he thinks the ordinance allows the "Little person" to get through the process with 1 united burden. Mr. Scholberg 'also recommended that cases before the commission that relate to affordable housing be given a high priority and moved ahead of other projects. Commission Discussion. A lengthy discussion ensued over the content of the ordinances and the processf adopted. Specific time limits for each step in the process were also discussed and suggested that they be incorporated into the ordinances. Mr. Carman moved to recommend Draft C. Ms. Sherwood seconded the motion and all were in favor. Mr. Carman roved to recommend Draft 2A with modifications a provided b� staff. Ms. Sherwood seconded the motion.
