AN ORDINANCE PROVIDING FOR THE CONDEMNATION
OF AN EASEMENT INTEREST IN CERTAIN REAL
PROPERTY IN THE CITY
WHEREAS, the City of Port Townsend, by its officers has
attempted to purchase the real property described below for public
purposes, but has been unsuccessful in purchasing said property
by reason of a failure to negotiate and agree upon a purchase
p~ice, and
WHEREAS, the City finds that said real property is necessary
for public purposes, including but not limited to the establish-
ment of a public sanitary sewer system, to the property and to
properties in the area pursuant tx) a local improvement district,
or by other means, and for the provision of other public utilities
in and near that part of the City, for the benefit of the public,
and that in order to acquire such property, condemnation pro-
ceedings will have to be taken pursuant to Title 8, P. evJ..sed Code
of Washington, now therefore, ~
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR
SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS:
Section 1.
The City of Port Townsend does hereby declare its desire
and intent to present to the Superior Court of the State of
Washington for Jefferson County, a Petition for the condemnation
of the following described real property, to be used for the pur-
poses and any other public purposes as set forth above:
As set forth in attached Exhibit A, wh'ich is by this
reference incorporated herein as if set forth in full.
Section 2
The City of Port Townsend shall pay compensation therefore
to the owners of said lands from the general funds of the City of
Port Townsend.
Section 3
~he Mayor of the City of Port Townsend and the City Clerk
are hereby authorized and directed to sign and verify the-Petition
and any and all other papers which may be required in said pro-
ceedings.
Section 4
The City Attorney for Port Townsend is authorized and
directed to con-~ence and conduct any and all proceedings necessary
for the condemnation of such property.
Section 5
This Ordinance shall take effect upon its passage,
approval and publication in the form and manner provided by law.
Read for the first, second and third times, passed by
the City Council and approved by the Mayor on this ~-~ day of

Exhibit A to Ordinance
A forty (40) foot wide construction easement and a twenty (20)
foot wide permanent maintenance easement and sewer line ease-
ment, the centerline of each being described as follows:
Over, under, across and upon that portion of Section 34, Town-
ship 31 North, Range 1 West, W.M., Jefferson County, Washington,
described as follows:
COMMENCING AT THE SOUTHWEST CORNEP OF SAID SECTION 34;
THENCE NORTH 01' 05' 56" EAST ALONG THE WESTERLY LINE OF SAID
SECTION 16, A DISTANCE OF 1,633.46 FEET TO THE NORTHWEST CORNER
OF THE TACOMA ADDITION TO THE CITY OF PORT TOWNSEND AS SHOWN ON
A MAP RECORDED IN VOLUME 1 OF PLATS, PAGE 81, RECORDS OF SAID
jEFFERSON COUNTY, WASHINGTON;
THENCE SOUTH 88° 35' 19" EAST ALONG THE NORTHERLY LINE OF SAID
PLAT OF THE TACOMA ADDITION, A DISTANCE OF 518.29 FEET TO THE
NORTHERLY TERMINUS OF THE CENTERLINE OF ROSECRANS STREET AS
SHOWN ON SAID PLAT OF THE TACOMA ADDITION, SAID NORTHERLY
TERMINUS ALSO BEING THE TRUE POINT OF BEGINNING OF THE
CENTERLINE OF SAID EASEMENT:
THENCE ALONG SAID CENTERLINE NORTH O1° 11' 43" EAST ALONG THE
NORTHERLY PROLONGATION OF THE CENTERL]NE OF SAID ROSECRANS
STREET, A DISTANCE OF 246.72 FEET;
THENCE NORTH 82© 22' 15" EAST, A DISTANCE OF 175.00 FEET;
THENCE NORTH 58° 26' 24" EAST, A DISTANCE OF 239.42 FEET;
THENCE NORTH 43© 15' 51" EAST, A DISTANCE OF 820.00 FEET;
THENCE SOUTH 43° 10' 12~' EAST, A DISTANCE OF 232.01 FEET TO AN
INTERSECTION WITH THE CENTERLINE OF HENDRICKS STREET AS SHOWN
ON THE PLAT OF MONTANA ADDITION TO THE CITY OF PORT TOWNSEND
RECORDED IN VOLUME 2 OF PLATS, PAGE 31, RECORDS OF SAID
JEFFERSON COUNTY, WASHINGTON, SAID INTERSECTION BEING IHE
EASTERLY TERMINUS OF THE CENTERLINE OF SAID EASEMENT
THE SIDELINES OF SAID STRIP SHALL BE PROLONGED OR SHORTENED TO
~ERM!NATE ON THE CENTERLINE OF SAID HENDRICKS STREET AND THE
NORTHERLY LINE OF SAID TACOMA ADDITION.
