AN ORDINANCE AMENDING ORDINANCE NUMBER 2046 BY
ELIMINATING RESERVATION OF A UTILITY EASEMENT IN
FAVOR OF THE CITY IN CONNECTION WITH VACATION OF
THE ALLEY IN NATIONAL CITY ADDITION, BLOCK TWO
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR
SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS:
I. That Ordinance No. 2046 be and the same is here and
hereby amended in its entirety to read as follows; and the
City hereby adopts the following:
Se.c.qion !. That that portion of the alley lying between
Lots 4 thru 11 and Lots 12 thru 19,of Block 2, of the National
City Addition to the City of Port Townsend, within the City of
Port Townsend,be and the same is hereby vacated.

S~tipD. ~2. (S.e~q~-~?-~ That the vacation of the alley as
aforesaid is conditioned upon the following:
a. No structure shall be built , erected or maintained at
any point within twenty-five (25) feet of the northerly edge of
the State Road 20 Right-of-Way, upon or over the lots described
above.
b. That Lots 4 thru 9; Lots 10 thru 13, and lots 14 thru
19,all inclusive, shall remain in common ownership and not
severed in anyway or manner, unless legal access is first provided
to each lot or lots so that no lot or lots are left without legal
access.
c. That, prior to publication of this ordinance and its
effective date, a Restrictive Covenant shall be executed by the
owners of the property described above, in a form and manner
acceptable to the City of Port Townsend, providing for each of
the above restrictions, that the same run with the land, and that
such document cannot be modified or terminated in anyway without
the prior approval of the City.
.~c.tion 3. (See~.~-4~)That this ordinance shall be published
after compliance with the conditions set forth herein, and com-
pliance with Chapter 12.20 of the Port Townsend Municipal Code
pertaining to compensation and payment of costs to the City.
Sect!on .4. (~e,e.~g.~-~T)This ordinance shall take effect
upon its passage, approval and publication in the form and manner
provided by law.
II. This amendatory ordinance shall take effect upon its passage,
approval and publication in the form and manner provided by law,
and shall be recorded with the Auditor for Jefferson County, Wash-
ington.

Read for the first, second and third times, passed by the
City Council for the City of Port Townsend and approved by
the Mayor on June 2, 1987.
