AN ORDINANC~ relatin~ to parking requirements, definin~
a Downtown Parking District, amending Section 17.28.020
of the Port Townsend Municipal Code to extend the area
in which the off-street parking required for a par-
ticular use must be located, reducin~ certain parking
requirements in the Downtown Parking District, encour-
aging retention or creation of on-street parking
spaces, and permitting payment of a fee in-lieu-of
parking spaces in satisfaction of certain parking
requirements.
past studies of parking in downtown Port Townsend
have questioned whether the s~ecific parking requirements of the
Port Townsend Municipal Code are appropriate and practicable for
current conditions, and;
WHEREAS, specific recomendations were made in the "Downtown
Parking Ordinance Review" conducted in 1986 by Doug Baker of the
Association of Washington Cities and in a recent City staff
discussion paper entitled "Parking in Downtown Port Townsend",
and;
~EREAS, over the past several months numerous community
meetings have been held at which many citizens have provided
information and suggestions regarding parking in downtown Port
Townsend, and;
NHEREAS, the Port Townsend Planning Comission has conducted
public forums and hearings and submitted on October 29, 1987,

recommendations for certain changes to the Port Townsend
Municipal Code relating to parking, and;
~HEREAS, the City Council finds that downtown ~ort Townsend
presents unique parking concerns, includi~ but not limited to
the following:
(1) Available parking is not evenly distributed throughout
the downtown area, nor is parking supply generally located in
close proximity to peak demand locations,
(2) Present and anticipated parking shortages indicate an
increasing need for additional on- and off-street parking spaces,
(3) Because many redevelopment opportunities are within
existing historic buildings, and because available downtown land
area is so constrained by the bluff and the waterfront, desirable
future development may be thwarted by parking requirements which
no longer serve the orderly redevelopment of downtown Port
Townsend, and
(4) Certain parking improvements may be more efficiently
made through the flexibility afforded by a fee-in-lieu of parking
spaces alternative, and;

WHEREAS, the City Council finds that there will be no
significant adverse environmental impact as a result of these
amendments, now therefore,
THE CITY COUNCIL OF THE CITY OF PORT TONNSEND DOgS ORDAIN AS
FOLLOWS:
~ A new Section 17.08.148 is hereby added to the Port
Townsend Municipal Code to read as follows:
17.08.148 Downtown Parkin~District. "Downtown Parking
District" means that area included in the C-II, C-III and P-
I zoning districts from Admiralty Inlet to Van Buren Street
between Port Townsend Bay and Jefferson Street, excluding
the P-I zoned block bordered by Van Buren, Jefferson,
Harrison and Washington Streets.
~ Section 17.28.020 of the Port Townsend Municipal Code
is hereby amended as follows:
17.28.020 Location. Off-street parking facilities shall be
located as hereinafter specified; where a distance is
specified, such distance shall be the walking distance
measured from the nearest point of the parking facility to

the nearest point of the building that such facility is
required to serve:
(1) For one and two family dwellings: on the same lo~ with
the building they are required to serve;
(2) For multiple dwellings: not more than one hundred
feet;
and boardinghouses, fraternity and sorority houses: not
more than three hundred feet;
(4) For uses within the Downtown Parkin~ District: within
or ~mmediatel? ad~acent to the Downtown Parking District.
(5~ For uses other than those specified above: not more
than five hundred feet.
For hospitals, sanitariums, homes for the aged, rooming

Townsend Municipal Code to read as follows:
17.28.100 Downtown Uses--Reduced Reauirements. The
parking requirements prescribed in this Chapter may be
reduced by one of the following provisions as may be
applicable:
(1) For uses within the Downtown Parking District
the parking requirements prescribed in
Section 17.28.080 are reduced to seventy-five
percent of the requirements which would
otherwise apply.

(2)
For uses within the Downtown Parking District
which are to be established in a proposed
building or building expansion the design of
which has been found by the Port Townsend
Historic Preservation Commission to
contribute to the Port Townsend Historic
District, the parking requirements prescribed
in Section 17.28.080 are reduced to forty-
five ~ercent of the requirements which would
otherwise apply.
~ A new Section 17.28.110 is hereby added to the Port
Townsend Municipal Code to read as follows:
17.28.110 On-Street Parking_ Spaces. If the proposed
parking area plan submitted pursuant to Section 17.28.090
would require elimination of one or more existing on-street
parking spaces, the parking requirements prescribed in
Section 17.28.080 are increased by two off-street spaces for
each on-street space to be eliminated, provided than such
requirements are reduced by two off-street parking spaces
for each on-street parking space created or restored by said
plan.

~ A new Section 17.28.120 is hereby added to the Port
Townsend Nunicipal Code to read as follows:
17.28.120 Naiver of Reauirements. Within the Downtown
Parking District, the Board of Adjustment may waive all or
part of the parking requirements prescribed in Section
17.28.080 upon request by the applicant to pay a fee into
the Parking Improvement Fund pursuant to Section 17.28.130
in-lieu-of furnishing the required parking spaces. In
making its determination on the request, the Board shall
consider:
(1) The extent to which the parking requirements ehich
apply to the proposed development impose a particular
hardship u~on the applicant;
(2) Nhether granting the request ~ould be unreasonably
burdensome to other property o~ners in the Downtown Parking
District; and
(3) Whether the granting of the request would lead to a
better overall result than ~ould strict adherence to the
parking requirements of this Chapter for the purposes of
encournging appropriate land uses, improving podestrian
circulation and achieving better parking design.

The fee-in-lieu of parking spaces shall be $4,270 per space
required or such other amount as the City Council shall
hereafter set by ordinance.
Any such agreement shall be made in compliance with
applicable state laws.
~ A new Section 17.28.130 is hereby added to the Port
Townsend Bunicipal Code to read as follows:'
17.28.130 In-lieu Park~n~ Fees-.Fund Created--Parking_
Improvement Plan. There is hereby created in the city
treasur~ a special fund designated the "Parking Improvement
Fund" into which in-lieu parking fees shall be deposited to
be expendedonly for public improvements listed in a
Parking Improvement Plan adopted by the City Council. The
City Council may from time to time direct that other monies
be transferred into the fund to be used for the purposes of
the fund.
The fund shall be used exclusively for planning,
acquisition, design, development, construction, financing,
maintenance and Operation of off-street parking facilities
within or i~aediately adjacent to the Downtown Parking
District, all consistent with the specific project

priorities set forth in the Parking Improvement Plan as
hereafter adopted or aeended by the City Council.
~ Severability. In the event any one or more of the
provisions of this ordinance shall for any reason be held to be
invalid, such invalidity shall not affect or invalidate any other
provision of this ordinance, but this ordinance shall be
construed and enforced as if such invalid provision had not been
contained therein; provided, that any provision which shall for
any reason be held by reason of its extent to be invalid shall be
deemed to be in effect to the extent permitted by law.
~ Kffective Date.
This ordinance shall become
effective five days after its passage and publication.
