A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON AUTHORIZING THE CITY MANAGER TO SIGN AN AGREED
NOTICE OF CORRECTION WITH THE WASHINGTON DEPARTMENT OF
HEALTH ALLOWING THE CITY OF PORT TOWNSEND TO WORK TOWARD
FULL COMPLIANCE WITH THE LT2ESWTR WITHOUT FURTHER
ENFORCEMENT ACTION BY THE DEPARTMENT
WHEREAS,the City of Port Townsend operates an unfiltered water system that draws water
from the Big and Little Quilcene Rivers and is therefore subject the appropriate state and federal
regulations for surface water to include the Long Term 2 Enhanced Surface Water Treatment
Rule (LT2ESWTR); and
WHEREAS,the City had been pursuing ultraviolet treatment as the means for LT2ESWTR
compliance; and
WHEREAS,the Washington State Department of Health (DOH) determined that the City's
current watershed control program does not meet the criteria for the water system to remain
unfiltered and directed the City to either upgrade the Watershed Control Plan or implement
filtration as the method of treatment; and
WHEREAS,the City chose to implement a membrane filtration system requiring additional
time to pilot test, design, construct, and startup the treatment plant taking the project completion
of October 2016 beyond the LT2ESWTR mandated completion date; and
WHEREAS,the DOH has proposed an Agreed Notice of Correction that will allow the City
to operate the water system and continue to address these compliance issues without further
enforcement action by the DOH; and
. WHEREAS,without this agreement the City may not be eligible for certain state and
federally funding programs for current and future water related projects and may be subject to
further enforcement actions by the DOH; and
WHEREAS,the City staff has participated in the development of the Agreed Notice of
Correction and feels that it can reasonably be implemented by the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend as follows: The City Manager is authorized to sign the Agreed Notice of Correction
with the Washington State Department of Health concerning the City's implementation of state
and federal surface water treatment regulations.
ADOPTED by the City Council of the City of Port Townsend at a regular meeting thereof,
held this 1+t, day of April, 2014.
