HomeMy WebLinkAbout14-006 Authorization for Amended Contract with DM Disposal to provide Solid Waste collection and disposal services Resolution 14-006 Page 1. of 2 RESOLUTION NO. 14-006 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, WASHINGTON AUTHORIZING THE CITY MANAGER TO SIGN AN AMENDED CONTRACT WITH D.M. DISPOSAL TO PROVIDE SOLID WASTE COLLECTION AND DISPOSAL SERVICES. WHEREAS, DM Disposal Company, Inc. presently has a contract with the City to provide solid waste collection and disposal services; and WHEREAS,the City Administration has been very satisfied with the service provided by DM Disposal over the past 13 years of the contract; and WHEREAS,the City and DM Disposal both desired to make changes to the existing contract prior to entering the final 5-year contract period of the contract; and WHEREAS, good-faith negotiations have taken place over the past year and the primary changes to the contract have been agreed to by both parties. These changes include: • The contract to be extended for a 5-year term effective 1 April 2014 with two mutually agreed to 5-year extensions. • DM Disposal will contribute $5000 in 2014 and in 2015 and, beginning in 2017 $10,000/year for sidewalk recycling and trash containers and other solid waste related programs. • DM Disposal will sponsor an annual Spring Clean-up program to collect certain larger items not normally part of the regular collection program (without cost to the customer for the pick-up). • Residential and Commercial collection fees will be adjusted to reflect the increased cost of service. The cost adjustments are broken down into four categories: 1) Bi- annual Consumer Price Index (CPI) Adjustment; 2) Additional One Time Adjustment; 3) Bad Debt; 4) Jefferson County Transfer Station Tipping Fee increases; • Any minor contract language changes found necessary to clarify the contract administration; and WHEREAS, City staff briefed the City Council on 18 February 2014 on the primary elements of the amended contract and the major changes with respect to the current contract, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port Townsend as follows: The City Manager is authorized to sign an amended agreement with DM Disposal to provide both solid waste collection and disposal services, provided the terms of the final contract are substantially consistent with the terms of the amended contract as presented to the City Council.
