AN ORDINANCE VACATING THE SOUTHEAS'TERLY ONE-HALF BOUNDARY OF THE OAK STREET RIGHT-OF-WAY TO A PRO~ii!.~?~ JECTION OF THE SOUTHWESTERN BOUNDARY OF LOT 5, BLOCK 6, PETTIGROVE'S FIRST ADDITION TO THE CITY ~O~'~~~ .... OF PORT TOWNSEND; ESTABLISHING CONDITIONS TO THE VACATION AND AN EFFECTIVE DATE. THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SES- SION ASSEMBLED, DO ORDAIN AS FOLLOWS: Section 1: That that portion of the southeasterly one-half of Cosgrove Street, extending from:the eastern boundary of the Oak Street right-of-way to a projection of the southwestern boundary of Lot 5, Block 6, Pettygrove's Addition, at a right angle to the southeastern boundary of Cosgrove Street, be and the same is hereby vacated. Section. 2.:~ That the street vacation aforementioned is con- ditioned however on the following: (A) That all fees and compensation pursuant to Chapter 12 of the Port Townsend Municipal Code must be first paid by the street vacation applicant to the City Treasurer for the City of Port Townsend, and upon such payment, that a certified copy of th~s ordinance shall then be recorded by the City Clerk with the Jefferson County Auditor. (B) That the street vacation shall be cancelled and become automatically null and void one year from the date of this ordinance if said fees and compensation have not been paid by the applicant and received by the City Treasurer. Section 3: This ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law, and after it has been recorded with the Jefferosn County Auditor pursuant to Section 2 of this Ordinance.
