TO THE VACATION OF THAT PORTION OF VIRGINIA PLA.~E,~~~
FORb!ERLY KNOWN AS JEFFERSON PLACE, BETWEEN COOK A~'
NUE AND PEARY AUENUE; AND AN UNNamED CIRCULAR STREET
LYING WEST OF THE FOWLER P~K ADDITION PLAZA; AND
THE WESTERN PORTION OF THE FOWLER PARK ADDITION
PLAZA; FOR THE PURPOSE OF CORRECTING AN ERRONEOUS
LEG~ DESCRIPTION; ESTABLISHING CONDITIONS TO THE
STREET VACATION AND AN EFFECTIVE DATE.
WHEREAS, the City Council for the City o~ Port Townsend, pursuant
to S~reet Vacation Application 8801-02, passed Ordinance No. 2109 on
April 19, 1985, purporting to vacate that portion of Virginia Place,
formerly known as Je~£erson Place, and also the western portion of
Foweler's Park Addition Plaza, all lying between Cook Avenue and Peary
Avenue within ~he Fowler Park Addition ~o the City of Port Townsend;
and
WHEREAS, Ordinance No. 2109 ~ails to adequately describe that
portion of the Fowler Park Addition Plaza which was intended to be
vacated, and the City Council desires to correct the same, now there-
fore
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION
ASSEMBLED, DO ORDAIN AS FOLLOWS:
Section 1. Section 1 of Ordinance No. 2109 is here and hereby
amended to read as follows:
"Section 1: That ~hat portion o~ Virginia Place, formerly known
as Jefferson Place, lying between Cook Avenue and Peary Avenue (7);
together with tha~ certain unnamed circular street lying west of the
Fowler Park Addition Plaza and east of the west reserve thereof, be-
tw. een Peary Avenue and Cook Ave.nue; tqgether with all of the western
portion of the Fowler's Park Addition Plaza, lying i(be%wee~) west of
the intersection o~ Cook Avenue and Peary Avenue, and east of the
above-described unnamed circular street, be and the same a. re.. L(~)
hereby'vacated."
Section 2: That. the s~reet vacation aforementioned is condi-
~.ioned, however, upon the following:
:'(A) All fees and compensation pursuant to Chapter
12 o~ the Port Townsend Municipal Code must be paid by the street
vacation applicant to ~he City Treasure~ prior to the recording of
this Ordinance with the Je££erson County Auditor,
::Section 3: The City Co.~ncil £or the City of Port Townsend here
and hereby authorizes the Mayor -and the City Clerk of the City to
execute a Quit. Claim Deed in favor of the parties entitled thereto,
to the above-described vacated property.
Section 4: This Ordinance shall take effect upon its passage,
approval and publication in the form and manner provided by law, and
after its being recorded with the Jefferson County Auditor pursuant
to Section 2(A) o~ this Ordinance.
