HomeMy WebLinkAbout2138 Vacating a Portion of Willson Street ORDINANCE NO. ~ S~ AN ORDINANCE VACATING THAT PORTION OF LYING TWENTIETH STREET~ RESERVING ~ UTILITY CITY OF PORT TOWNSEND~ ESTABLISHING CONDITIONS TO THE STREET V~C~TION~ ~ND ESTABLISHING ~ EFFECTIVE D~TE. THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND IN REGULAR SESSION ASSEMBLED DO ORDAIN AS FOLLOWS: Section i. That that portion of platted but unopened Wilson Street extending from platted Discovery Bay Road North to platted and unopened Twentieth Street, and including the entire 60-foot width of said Wilson Street right-of-way, be and the same is hereby vacated. Section 2. That the City of Port Townsend reserves unto it- self and the public an easement for utility purposes, 12 feet in width, located six feet on either side of the centerline of the existing sewer line through the vacated street. Section 3. That the street vacation aforementioned is condi- tioned, however, on the following: A. That all fees and compensation pursuant to Chapter 12 of the Port Townsend Municipal Code must first be paid by the street vacation applicant to the City Treasu~rer for the City of Port Townsend, and upon such payment, that a certified copy of this Ordinance shall then be recorded by the City Clerk with the Jef- ferson County Auditor. B. That the street vacation shall be cancelled and become automatically null and void one year from the date of this Ordin- ance if said fees and compensation have not been paid by the ap- plicant and received by the City Treasurer. Section 4. This Ordinance S~atl take effect upon its passage, approval and publication in the form and manner provided by law, and after it has been recorded with the Jefferson County Auditor pursuant to Section 3 of this Ordinance. Read for the first, second and third times, passed by the City Council for the Cit~ of Port Townsend, and signed by the Mayor of the City this .~ ~ day of December, 1988.
