HomeMy WebLinkAbout2153 Vacating an Alley in Block 50 of Eisenbeis AdditionOR-DINANCE NO. 2 15-3 AN ORDINANCE VACATING THE ALLEY LYING BETWEEN LOTS 1 THROUGH 7 AND LOTS 26 THROUGH 32 OF BLOCK 50, EISENBEIS ADDITION TO THE CITY OF PORT TOWNSEND, AND ESTABLISHING AN EFFECTIVE DATE WHEREAS, the City received Street Vacation Application Number 1181-01 by Ivan Crutcher, seeking the vacation of the alley located between Lots 1 through 7 and Lots 26 through 32 of Block 50, Eisen- beis Addition to the City of Port Townsend; and WHEREAS, the City Council for the City of Port Townsend duly held a Public Hearing upon such application on January 5, 1982, following a hearing by the Planning Commission recommending approval of said vacation; and WHEREAS, the City Council adopted Findings of Fact presented by the Planning Commission, and a motion to approve the application, retaining an easement for utilities, at its regular meeting on Jan- uary 5, 1982; and WHEREAS, an Ordinance has never been passed vacating said alley, now, therefore THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SES- SION ASSEMBLED, DO ORDAIN AS FOLLOWS: Section 1. That that portion of the alley lying between Lots 1 through 7, inclusive, and Lots 26 through 32, inclusive, of Block 50, of the Eisenbeis Addition to the City of Port Townsend be and the same is hereby vacated. Section 2. That the City of Port Townsend, for itself, its suc- cessors and assigns, hereby reserves an easement 12 feet in width, for water, sewer, electric, telephone and television cable utilities, being located six feet on each side of the centerline of said alley. Section 3. This Ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law, and after it has been recorded with the Jefferson County Auditor. Read for the first, second and third times, passed~by the City Council for the City of Port Townsend and signed by the Mayor of the City of Port Townsend this ~ day of May, 1989.
