AN ORDINANCE VACATING THAT CERTAIN ALLEY LYING BETWEEN LOTS 1 THRU 5 AND LOTS 17 THRU 22, INCLU SIVE, BLOCK 4, NATIONAL CITY FIRST ADDITION TO TO THE ALLEY VACATION; AND ESTABLISHING AN EFFEC- TIVE DATE THE CITY COUNCIL FOR THE CITY OF PORT TOWNSEND, IN REGULAR SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS: Section 1. That that certain alley located and lying between Lots 1 thru 5 and Lots 17 thru 22, inclusive, of Block 4, National City. First Addition to the City of Port Townsend, be and the same is hereby vacated. Section 2. That the aforementioned alley vacation is conditioned however upon the following prior to its effectiveness: a. The applicant shall grant to the Puget Sound Power and Light Company a perpetual easement for electrical utility transmission/distribution facilities over that portion of the above-described alley which lies adjacent to Lots 4, 17, 18 and 19, Block 4, lying Southerly of the existing Olympic Gravity Water System easement, to be granted prior to publication or recordation hereof. b. A certified copy of the ordinance vacating the alley shall be recorded by the city clerk in the Jefferson County Auditor's office upon receipt by the city of all fees and compensation re- quired (Section 12.20.120, Port Townsend Municipal Code). The street vacation shall be cancelled and become automatically~nUlll and void ninety days after City Council action if said fees have not been paid. Section 3. This ordinance shall be effective after its passage, approval and publication in the form and manner provided by law and after its recording with the Jefferson Auditor as set forth in Section 2 (a) and-'(b) above. --~ Read for the first, second and third times, passed by the City Council of the City of Port Townsend and signed by the Mayor of the City this __~L~_day of _ ~/~f ._,1989.
