HomeMy WebLinkAbout2162 Public Records Disclosure ActORDINANCE NO. ~)~ AN ORDINANCE OF THE CITY OF PORT TOWNSEND IMPLEMENT- ING THE PUBLIC RECORDS DISCLOSURE ACT CONTAINED WITHIN C~UtPTER 42.17, OF THE REVISED CODE OF WASHING- TON; AND ESTABLISHING AN EFFECTIVE DATE WHEREAS, RCW 42.17.250 through RCW 42.17.340, inclusive, provide that each public agency shall make available for inspection pub- lic records, not otherwise exempt, and direct the City to adopt procedures concerning making such records available to the pub- lic, and WHEREAS, the City Council of the City of Port Townsend deems it in the interest of the inhabitants of the City to implement the Public Records Disclosure Act contained in RCW 42.17 by declar- ing the availability of public recordsf determining the exemption of certain records, and directing the custodian of the records of the City of Port Townsend to adopt reasonable procedures to en- sure compliance with this Ordinance and RCW 42.17, now, therefore, THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND~ IN REGULAR SESSION ASSEMBLED, DOES ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Port Townsend does hereby declare that all public records as defined in RCW 42.17.020, as now or hereafter amended, in the custody of the City shall be available for public inspection and copying in the form and manner and in accordance with the provisions of RCW 42.17.250 through RCW 42.17.340, inclusive, provided, however, that all rec- ords and parts thereof shall be exempt from disclosure as set forth in RCW 42.17.250 through RCW 42.17.340, inclusive, and in addition any other records falling within the specific exemption or exemp- tions of any other statute which exempts or prohibits disclosure of specific information or records. Section 2. The City Clerk is hereby directed to adopt reason- able rules, regulations and procedures to ensure compliance with this Ordinance and with RCW 42.17.250 through RCW 42.17.340, in- clusive, and to make available to the public in accordance with said laws as now or hereafter amended all public records except those specifically exempted from disclosure, and to protect said records from damage, disappearance or disorganization. Section 3. The City Clerk shall establish the following fees for services to fulfill the request for public records of the City: a. Copying, including copyright records only when sub- mitted as part of a public hearing: 10¢ per page be Searching of records $15 per hour; no charge for less than 30 minutes c. Preparing~ transcribing or providing such other assist- ance required to fulfill request $15 per hour; no charge for less than 30 minutes Certifying, authenticating or notarizing services $2 per page e. Other service~ including but not limited to photographic reproduction, postage, and computer usage applicable City costs + 20% Section 4. The City Clerk shall prepare an application for re- quest for public records, to include the name, address and organiza- tion the applicant is representing, if any, and the form shall in- clude a statement that the applicant agrees to pay for the services of the City of Port Townsend in searching and preparing and other- wise providing services pursuant to this Ordinance, and the document shall have a signature line for the applicant to execute. The City Clerk shall also provide any other necessary forms and procedures to implement this Ordinance to ensure compliance with this Ordinance and the provisions of RCW 42.17.250 through RCW 42.17.340, inclu- sive, as no~ or hereafter amended. Section 5. This Ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law.
