AN ORDINANCE AMENDING SECTION 1 OF NO. 1808 OF THE CITY OF PORT TOWNSEND, TO CORRECT CERTAIN ERRORS AND OMISSIONS THER~-~~~~ BY VACATING THAT PORTION OF ROSECRANS STREET LOCATED BETWEEN DISCOVERY AND TWENTIETH STREET; THAT PORTION OF ROSECRANS STREET LO- CATED BETWEEN BLOCKS R AND S OF THE EISEN- BEIS ADDITION TO THE CITY OF PORT TOWNSEND; THAT PORTION OF EIGHTEENTH STREET BETWEEN McCLELLAN'D AND ROSECRANS STREETS; AND THAT PORTION OF NINETEENTH STREET BETWEEN McCLEL- LAND AND ROSECRANS STREETS, ALL SITUATE IN THE CITY OF PORT TOWNSEND, WASHINGTON; AND ESTABLISHING AN EFFECTIVE DATE WHEREAS, Street Vacation Application No. 134, dated January 17, 1977, was filed with the City and subsequently amended on May 23, 1977; and WHEREAS, the application as amended requested the vacation of Rosecrans Street between Discovery and Twentieth Street; Rosecrans Street between Blocks R and S of the Eisenbeis Addition to the City of Port Townsend; Eighteenth Street between McClel- land and Rosecrans Streets; and Nineteenth Street between McClel- land and Rosecrans Streets; and WHEREAS, Street Vacation Application No. 1.34 was and is the only street vacation application whic~ was filed and pending in connection with the application for approval of the Towne Point Planned Unit Development, which Planned Unit Development was sub- sequently approved on July 19, 1977; and WHEREAS, on January 3, 1978, it was the intention of the City Council of the City of Port Townsend to approve Street Vacation Application No. 134 as amended and as set forth above; and WHEREAS, due to clerical and other errors, the application as submitted and amended was not properly voted upon and the sub- sequent ordinance,. Ordinance No. 1808, of the City of Port Town- send, which was passed in part to provide for the street vacation, was therefore in er'ror; and WHEREBS, the present City Council for the City of Port Town- send desires to correct such errors and omissions, now, therefore, THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND IN REGULAR SESSION ASSEMBLED DO ORDAIN AS FOLLOWS: Section ~. Section 1 of Ordinance No. ~808 is here and hereby amended to read as follows: "Section 1. That portion of Rosecrans Street located between Blocks R and S (S~ee~) of the Eisenbeis Addition to the City Port Townsend,i toge~ther with that portion of Rosecrans Street l~ing between DiscoverM_ .S~reet and Twentieth Street.;. t.gge!~her with Eighteenth Street lyi~g .between McClelland and Rosecrans Streets~ t~gether with Nineteenth Street located between McClelland and Rosecrans Stre~.t.s.,. all situate in the CitM of Port Townsend, be and the same are (~) here and hereby vacated." Section 2. That upon and after the effective date of this ordinance, the City Clerk be and is hereby directed to record this ordinance with the Auditor for Jefferson County, Washington. Section 3. That this ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law.
