AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING THE PORT
TOWNSEND MUNICIPAL CODE CHAPTER 13.05 UTILITY RATES AND CHARGES,
INCLUDING CAPITAL SURCHARGE AND OUTSIDE-CITY MULTIPLIER, AND
EXCLUDING THE CAPITAL SURCHARGE FROM THE CITY UTILITY TAX, AND
ESTABLISHING AN EFFECTIVE DATE
FINDINGS AND RECITALS
1. The City's utilities are facing a significant number of capital project expenditures including
LT2 (long term treatment plan for secondary disinfection of our water system), 5M gal reservoir
replacement and City Lake Outfall.
2. The City retained Financial Consulting Solutions Group, Inc ("FCS"), Redmond, WA to
provide a water and sewer rate study and cost of service (COS) analysis.
3. The last comprehensive utility rate study was completed in 2007. A 2010 update focused on
funding utility operations and maintenance costs. Council has reviewed preliminary rate models,
including a September 2011 Forecast. On June 10, 2013 FCS made a presentation to the City
Council and provided a Water and Sewer Rate Update. The presentation included elements
consisting of revenue requirements, rate design, system development charges (SDC) update, and
outside-city multiplier.
4. FCS presented findings that the operating revenue of the water utility is not fully covering
overhead &maintenance expenses and rate increases will be needed to address existing operating
deficit and keep up with costs in subsequent years. FCS presented findings that the operating
revenue of the sewer utility is sufficient to cover overhead and maintenance costs. However, rate
increases will be needed to keep up with costs, especially as system reinvestment needs increase.
5. FCS recommended the adoption of proposed rates, the adoption of System Development
Charges (to be phased in over a two year period) and an increase of the outside-City multiplier
from 1.10 to 1.20.
6. Following review, the City Council determines to implement amendments to water rates and
sewer rates as set forth in this ordinance to address maintenance and operation rates, implement a
capital surcharge for capital improvements, update SDCs, and increase the outside-City
multiplier.
NOW THEREFORE, the City Council of the City of Port Townsend ordains as follows:
Section 1. Amendment. Chapter 13.05 of the Port Townsend Municipal Code, sections
13.05.030 Monthly Water Rates and 13.05.040 Monthly Sewer Rates, are amended as follows to
include rates, capital surcharge, and outside-city multiplier. Existing rates are repealed as new
rates set by this Ordinance take effect.

Section 2. Amendment. Section 5.84.030 Tax imposed of the Port Townsend Municipal Code,
are amended as follows (strike is deleted, underline is added)
5.84.030 Tax imposed.
From and after January 1, 1982, there is levied upon, and there shall be collected from, every
person, firm or corporation engaged in carrying on the following business for hire or for sale of a
commodity or a privilege of so doing business as defined in this section:
G. There is levied a fee or tax equal to 20 percent on the gross revenues of the following utilities:
1. The city's stone and surface water utility established under Chapter 13.31 PTMC;
2. The city's water system established as provided in Chapters 13.11 through 13.17 PTMC
(the "water code"); and
3. The city's sewer system established as provided in Chapters 13.21 through 13.24 PTMC
(the "sewer code").
Funds shall be allocated as follows:
a. Revenues from first 10 percent: general fund services;
b. Revenues from second 10 percent (amount collected in excess of the first 10
percent): 85 percent to street fiend and 15 percent to public safety.
The capital surcharge component of the water and utility rates is excluded from the City's
Utility Tax.
Section 3. Severability. If any provision of this ordinance or its application to any person or
circumstance is held invalid, the remainder of the ordinance, or the application of the provision
to other persons or circumstances is not affected.
Section 4. Effective Date. This ordinance shall take effect and be in force five days after the
date of its publication in the manner provided by law. Rates go into effect as provided in
Exhibits A and B to this Ordinance.
